ORDINANCE NO. 3380-14 <br />An Ordinance authorizing a Pilot Project for Micro -housing for Trinity Lutheran <br />College Students at the Southwest corner of Oakes and California with off-street, <br />off -site parking at the Trinity Lutheran College Garage at the Southeast corner of <br />Wetmore and California, Amending Section 34 of Ordinance No. 1671-89 and <br />Section 7 of Ordinance No. 2347-98, as amended <br />WHEREAS, the City Connoil finds the following: <br />1. Footprint investments, LLC, (Footprint) owns property located on the southwest comer <br />of California Street and Oakes Avenue, in the B-3 zone (Central Business District), <br />Iegally described as Lots 24, 25 and 26 of Block 665, Plat of Everett, according to the <br />plat thereof recorded in Volume 3, Page 32, records of Snohomish County, WA. (the <br />"Property"). <br />2. Footprint proposes developing micro -housing (the "Project") on the Property to house <br />students attending Trinity Lutheran College (TLC), which is located two blocks west of <br />the Property. <br />3. Footprint proposes providing off-street parking for the Project on the block between the <br />Project and TLC in an existing parking garage owned by TLC, located on property <br />legally described as Lots i through. 5 and Lots 22 through 26, inclusive, of Block 666, <br />Plat of Everett, according to the plat thereof recorded in Volume 3, Page 32, records of <br />Snohomish County, WA. The Zoning Code requires that off-street parking required for a <br />residential use be located on the sarne site as the use; <br />4. Footprint proposes using the Multifamily Housing Property Tax Exemption provided by <br />EMC Chapter 3.78, which requires that parking for residential use be provided on the <br />same site or across an alley from the site upon which the housing is located; <br />5. There is no use category in the Zoning Code for "student housing,' but the Code does <br />provide an administrative process for determining if an unlisted use should be permitted <br />in a specific zone; <br />6. There is no off-street parking standard listed in the Zoning Code for "student housing," <br />but the Code does provide an administrative process for determining the appropriate off- <br />street parking for an unlisted use; <br />7.
