ORDINANCE NO. 4(0 • AN ORDINANCE granting to THE MEDICAL AND DENTAL BUILDING COMPANY, INC. the right to construct, maintain and operate an overhead covered walkway across the alley west of Colby Avenue in Block 624, Plat of Everett, Snohomish County, Washington, approximately fifty-five (55) feet north of California Street, and a canopy across the alley in said block 624 at the north property line of California Street specifying the condition of the grant and providing for the acceptance of this franchise. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That there is hereby granted to THE MEDICAL AND DENTAL BUILDING COMPANY, a corporation, and to its successors and assigns, hereinafter called "Grantee` the right, privilege and authority to construct, maintain and operate an overhead covered walkway hereinafter referred to as `Covered Walkway" across a portion of the alley west of Colby Avenue in Block 624, Plat of Everett, Snohomish County, Washington, approximately fifty-five (55) feet north of California Street and a canopy across the alley in said block 624 at the north property line of California Street. The exact location of said Covered Walkway and Canopy to be approximately in the location shown .on the plan on file in the City Engineer's office, W 0 drawing No. 596 . Said Covered Walkway shall be used by Grantee for a pedestrian walk -way over the alley. Said CoveredWalkway and Canopy shall be constructed in accordance with the plans and specifications approved by the City of Everett before construction work is commenced and shall have a minimum clearance of fourteen (14) feet between said Walkway and Canopy and the surface grade of the alley. Section 2: It shall be the responsibility of THE M DICAL AND DENTAL BUILDING COMPANY, INC. to make all nec- essary arrangements with the Snohomish County Public Utility District No. 1 and the West Coast Telephone Company for changes in their lines made necessary by the construction of the Covered Walkway and Canopy all at no expense to the City of Everett. Section 3: All the rights, privileges and authority hereinafter conferred upon and granted to said Grantee, its successors and assigns shall cease and terminate at 12 o'clock midnight, fifty (50) years from the effective date of this ordinance, unless renewed, and within ninety days thereafter said Grantee, its successors and assigns shall remove said Overhead Walkway and Canopy and replace the alley and utilities in its original condition. That this franchise shall, upon application of the Grantee be renewed, if the Grantee shall have complied with its provisions and unless public convene ience shall require its termination.
