to the City Poles,and shall be responsible for any damage to the City Poles to the extent <br /> caused by Company and shall coordinate with City an appropriate schedule and plans <br /> for repairs to any damaged City Poles, which repairs will be at the sole cost of <br /> Company. <br /> 14.2. City shall have no obligation to maintain or safeguard the City Poles, except that City <br /> shall not intentionally permit access to the Site Equipment to any third party without <br /> the prior approval of Company,except as otherwise provided herein or in an emergency <br /> situation. <br /> 14.3. Company must be a member of the state one-call service and comply with all <br /> provisions of Ch. 19.122 RCW. <br /> 15. Repairs by City; Increased Maintenance Costs; Emergency Situations <br /> 15.1. City reserves the right to make alterations, repairs, maintenance, additions, removals, <br /> improvements, and all other similar work to all or any part of the City Poles for any <br /> purpose. City shall make a good faith effort to give Company forty-five(45)days prior <br /> notice of any City work if such work will impair the operation of the Site Equipment. <br /> To the extent feasible, City will endeavor to provide Company with as much prior <br /> notice as possible for major site changes. Such notice shall be given to the Company <br /> by calling (800) 264-6620. Further, City shall allow a representative of Company to <br /> observe the work and City shall take reasonable steps not to disturb Company's normal <br /> use of the Site Equipment. Company's use of the City Poles may not impede or delay <br /> City's authority and ability to make any changes to the City Poles. <br /> 15.2. Pursuant to the design requirements agreed to between the City and Company and as <br /> set forth in Section 10.5, Company shall install a disconnect switch to enable the City <br /> to disconnect Company's Site Equipment and power to the pole in order to safely work <br /> on the City Poles; provided, however, that City provide Company at least four (4) <br /> hours' notice prior to using such disconnect switch,or as much prior notice as possible <br /> in the event of an emergency. The City may turn on the override switch immediately <br /> after the public safety emergency or access has ended. The power feed design will <br /> accommodate the ability for City to disconnect power to the Pole in the case of an <br /> emergency. The power feed design must be reviewed and acknowledged as acceptable <br /> by the City prior to its installation. <br /> 15.3. City shall have no duty to Company to make any repairs or improvements to the City <br /> Poles. <br /> 15.4. City is not responsible for any third party damage to Site Equipment. <br /> 15.5. In the event that the Company's use or replacement of City Poles results in increased <br /> maintenance or repair costs to the City, Company shall, within thirty (30) days of <br /> receipt of written notification by the City, which shall include documentation <br /> evidencing such increase as the result of Company's use,pay City for the incremental <br /> maintenance or repair costs incurred by the City. <br /> 12 <br />
