28. Review of Plans & Approval of Contractor <br /> 28.1. Prior to the initial installation of any Site Equipment, the Company shall submit the <br /> following documents to the City for review, approval or denial: (i) completed Site <br /> License Addendum, (ii)the Emissions Report Letter, and (iii)the Administrative Fee. <br /> 28.1.1. Upon submission of a Site License Addendum, the City shall use good faith <br /> efforts to process the Site License Addendum within the time period prescribed <br /> by applicable Law, or if no time period exists, within a timely manner. The <br /> Administrative Fee shall accompany the submission of all Site License <br /> Addendums. City may request additional information during its review of the <br /> Site License Addendum. An application will be considered to be complete <br /> when all City questions are resolved. Processing a site addendum does not <br /> include the City's review and approval of any other necessary permits, <br /> including land use review, for the installation of the Site Equipment. <br /> 28.1.2. The City will review and process the Site License Addendums in chronological <br /> order(date and time) in which complete applications are submitted. Company <br /> acknowledges that staff considerations may limit the City's ability to review <br /> and process Site License Addendums. <br /> 28.1.3. All Site License Addendums requesting access to a City Pole must include a <br /> load bearing study to determine whether the attachment of Site Equipment may <br /> proceed without City Pole modification or whether the installation will require <br /> City Facility re-enforcement or replacement. If City Pole re-enforcement or <br /> replacement is necessary, Company shall provide engineering design and <br /> specification drawings demonstrating the proposed alteration to the City Pole. <br /> All engineering drawings submitted must be completed and stamped by a <br /> Professional Engineer. All Site License Addendums requesting the installation <br /> of a new City Pole shall include engineering design and specification drawings. <br /> For each Site License Addendum,the City shall: <br /> a. Verify that the Site License Addendum is complete and the <br /> Administrative Fee has been submitted. <br /> b. Review engineering design documents to determine: (i) compliance <br /> with contractual requirements under this Agreement; (ii) no <br /> interference with City public safety radio system, street lighting <br /> system, traffic signal light system, or other communications <br /> components; or (iii) inclusion of appropriate design of stealth and <br /> camouflage components necessary to comply with historic <br /> preservation requirements or aesthetic design elements; and <br /> compliance with City regulations. <br /> c. Determine if the City Facility is available and if the license of such City <br /> Facility is consistent with City's municipal obligations and proprietary <br /> interests consistent with Section 2.3. <br /> 21 <br />
