b. Poses a threat to public health or safety, or constitutes a public <br /> nuisance. <br /> c. The City determines that Company's exercise of its rights under this <br /> Agreement interferes with the use of the City Poles or structures <br /> thereon by a governmental agency with which the City has an <br /> agreement to provide services to the City, e.g. PSERN(or its successor <br /> entity); or <br /> d. That Company ceases to operate as a provider of telecommunications <br /> services under federal law. In such a situation the City shall have the <br /> option, in its sole discretion and upon six(6)months' written notice to <br /> Company, to terminate this Agreement and to require the removal of <br /> the Site Equipment from the City Poles, pursuant to Section 33, <br /> including the cost of any site remediation, at no cost to the City. <br /> 30.1.3. Immediate Removal. The City, may in its sole discretion, determine that <br /> exigent circumstances require immediate removal of Site Equipment from a <br /> City Facility. Such exigent circumstances may only include reasons of public <br /> health, safety or to provide street lighting. Company shall remove its Site <br /> Equipment within forty-eight (48) hours' notice, unless such longer period is <br /> provided by the City. The applicable Site License Addendum will terminate <br /> upon the removal of the Site Equipment. <br /> 30.1.4. Pole Removal. The City has the right to remove any City Poles that it <br /> determines in its sole judgment is unnecessary for its municipal purposes (for <br /> example street light operations). If the City decides to remove a City Pole, it <br /> will endeavor to provide Company with as much notice as possible, but shall <br /> provide a minimum of sixty (60) days written notice for Company to remove <br /> its Site Equipment from the City Facility. The applicable Site License <br /> Addendum will terminate upon the removal of the Site Equipment. <br /> 30.1.5. Pole Replacement. The City has the right to replace any City Poles that it <br /> determines in its sole judgment is necessary for its municipal operations. If the <br /> City decides to replace a City Pole, it will endeavor to provide Company as <br /> much notice as possible,but shall provide a minimum of sixty(60)days written <br /> notice for Company to remove its Site Equipment from the City Facility. The <br /> applicable Site License Addendum will terminate upon the removal of the Site <br /> Equipment. <br /> 30.1.6. New Site License Addendum. In the event of a pole removal or replacement <br /> and the applicable Site License Addendum is terminated, City shall grant <br /> Company the right to place its Site Equipment on a mutually agreeable new <br /> location, or on the replacement pole, as applicable. In either event, the City <br /> and Company will execute a new Site License Addendum reflect such new <br /> locations, and Company shall obtain all necessary permits and Government <br /> Approvals for the new Site License Addendum. <br /> 25 <br />
