Exhibit E <br /> Insurance Requirements <br /> A. Company shall maintain in full force and effect at its own cost and expense each of the <br /> following policies of insurance: <br /> (1) Commercial General Liability (CGL) insurance on an"occurrence" basis, including, but not <br /> limited to, products and completed operations,property damage, bodily injury and personal <br /> and advertising injury with limits of$5,000,000 per occurrence and $5,000,000 general <br /> aggregate. <br /> (2) Workers' Compensation insurance as required by Washington law, with Statutory Limits, <br /> and Employers' Liability insurance with a limit of$3,000,000 each accident/disease/policy <br /> limit. This amount can be obtained via a combination of primary and excess/umbrella <br /> liability policies. <br /> (3) Commercial Automobile Liability insurance covering all owned, leased, hired, or borrowed, <br /> with limits of$7,000,000 per accident for bodily injury and property damage. These <br /> amounts can be obtained via a combination of primary and excess/umbrella liability policies. <br /> (4) Excess/Umbrella Liability with a limit of$2,000,000 per occurrence and $2,000,000 <br /> aggregate providing coverage above the primary commercial general liability, commercial <br /> automobile liability and employer's liability coverage required above. <br /> If the Grantee maintains broader coverage the City shall be entitled to the broader coverage <br /> maintained by the Grantee. <br /> B. Upon receipt of notice from its insurer(s) Company shall use reasonable efforts to provide the <br /> City with thirty(30) days written notice of cancellation via first class mail. If the insurance is <br /> cancelled, Company shall provide a replacement policy. Company agrees to maintain <br /> continuous uninterrupted insurance coverage, in the amounts required above, for the duration <br /> of this Agreement and, in the case of the Commercial General Liability (CGL) insurance, for <br /> one (1)year after expiration of this Agreement for which evidence shall be provided. <br /> Deductibles and Self-Insured Retentions <br /> Any deductible of the policies or self-insured retentions shall not in any way limit <br /> Company's liability to the City. <br /> Other Insurance Provisions <br /> A. The insurance policies are to contain, or be endorsed to contain,the following provisions: <br /> (1) Excluding Workers' Compensation&Employer's Liability,the City, its officers, officials, <br /> agents (excluding City construction contractors and their subcontractors), employees, and <br /> volunteers are to be covered as additional insureds as their interest appears under this <br /> Agreement with respect to liability arising out of or resulting from Company's use and <br /> occupancy of the premises and the activities performed by Company under this Agreement <br /> and automobiles owned, leased, hired or borrowed by or on behalf of the Company. <br /> 43 <br />
