CITY OF EVERETT <br /> 477 <br /> PLANNING DIRECTOR DECISION <br /> REASONABLE USE REVIEW PROCESS I#18-005 <br /> October 02, 2018 <br /> The City of Everett Planning Director grants APPROVAL of a request by Don Shaffer to construct a <br /> new single family residence (SFR) with attached garage and rear elevated deck into a sixty foot (60') <br /> Category III wetland buffer at 30 112th Street SE, Everett, WA with the following conditions: <br /> 1. All work must comply with the recommendations of the Critical Area Study and Buffer <br /> Mitigation Plan prepared by Wetland Resources, Inc. with a revised date of September 28, 2018. <br /> Monitoring and maintenance will be the responsibility of the developer under the direction of the <br /> ecologist. Inspection of the plantings are required when completed. Contact Grace Pollard at <br /> 425.257.8807 to schedule an inspection. <br /> 2. The construction of a permanent fence or wall and a minimum of two (2) Environmentally <br /> Sensitive Area signs posted along the reduced wetland buffer edge are required. Signs may be <br /> purchased from the Permit Services Counter. <br /> 3. Record a Critical Area Site Plan (CASP) and the "Declaration of Critical Area Protective <br /> Covenant" prior to issuance of building permits. The CASP must be formatted to meet Snohomish <br /> County Auditor standards for recording and approved by the City of Everett's Planning Department <br /> prior to recording. <br /> 4. No improvements of any kind are permitted within ten feet(10')from the final buffer edge;this <br /> area is to remain vegetated yard space. <br /> The Planning Director has found that the applicant has demonstrated that the development has met <br /> Section 37.050.B.1 of the City of Everett zoning code as follows: <br /> There is no other reasonable use or feasible alternative to the proposed development with less <br /> impact on the environmentally sensitive area. <br /> a. The proposed development does not pose a threat to the public health, safety and welfare on or <br /> off of the subject lot. <br /> b. Any alterations permitted to the requirements of (the Zoning Code) shall be the minimum <br /> necessary to allow for reasonable use of the property. <br /> c. The inability of the applicant to derive reasonable economic use of the property is not the result <br /> of actions by the applicant in subdividing the property or adjusting a boundary line thereby creating <br /> the undevelopable condition after the effective date of the(the Zoning Code). <br /> d. The proposal mitigates the impacts on the environmentally sensitive areas to the maximum <br /> extent possible. <br /> This is an administrative decision that is appealable to the City's Land Use Hearing Examiner. Any <br /> appeal must be filed with the City within fourteen (14) days of the date of this notice.
