1 (1) By or upon an officer while in the execution of the duties of <br /> 2 his or her office; <br /> 3 (2) Riotously; <br /> 4 (3) With an intent to commit a felony; or <br /> 5 (4) By one family or household member against another or by one <br /> 6 intimate partner against another as defined in RCW ( (10 . 99. 020) ) <br /> 7 26. 50. 010 and was a crime of domestic violence as defined in RCW <br /> 8 10 . 99. 020. <br /> 9 Sec. 10. RCW 10 . 31 . 100 and 2019 c 263 s 911, 2019 c 246 s 6, <br /> 10 2019 c 46 s 5013, and 2019 c 18 s 1 are each reenacted and amended to <br /> 11 read as follows: <br /> 12 A police officer having probable cause to believe that a person <br /> 13 has committed or is committing a felony shall have the authority to <br /> 14 arrest the person without a warrant. A police officer may arrest a <br /> 15 person without a warrant for committing a misdemeanor or gross <br /> 16 misdemeanor only when the offense is committed in the presence of an <br /> 17 officer, except as provided in subsections (1) through (11) of this <br /> 18 section. <br /> 19 (1) Any police officer having probable cause to believe that a <br /> 20 person has committed or is committing a misdemeanor or gross <br /> 21 misdemeanor, involving physical harm or threats of harm to any person <br /> 22 or property or the unlawful taking of property or involving the use <br /> 23 or possession of cannabis, or involving the acquisition, possession, <br /> 24 or consumption of alcohol by a person under the age of twenty-one <br /> 25 years under RCW 66. 44 . 270, or involving criminal trespass under RCW <br /> 26 9A. 52 . 070 or 9A.52 . 080, shall have the authority to arrest the <br /> 27 person. <br /> 28 (2) A police officer shall arrest and take into custody, pending <br /> 29 release on bail, personal recognizance, or court order, a person <br /> 30 without a warrant when the officer has probable cause to believe <br /> 31 that: <br /> 32 (a) An order has been issued of which the person has knowledge <br /> 33 under RCW 26. 44 . 063, or chapter 7 . 92, 7 . 90, 9A. 40, 9A. 46, 9A. 88, <br /> 34 10 . 99, 26. 09, 26. 10, 26. 26A, 26. 26B, 26. 50, or 74 .34 RCW restraining <br /> 35 the person and the person has violated the terms of the order <br /> 36 restraining the person from acts or threats of violence, or <br /> 37 restraining the person from going onto the grounds of, or entering, a <br /> 38 residence, workplace, school, or day care, or prohibiting the person <br /> 39 from knowingly coming within, or knowingly remaining within, a <br /> p. 16 SHB 2473.SL <br />
