201803290404.007 <br /> 2 2 4 On-Site Services. The proposed plan must include a <br /> description of services available to residents of the Supportive Housing Facility The <br /> proposed plan must specifically state that on-site services will only be provided to <br /> residents of the Supportive Housing Facility and will not be provided to anyone else <br /> 2.2 5 Mitigation of Impacts The proposed plan must identify <br /> impacts on neighboring residential uses(including any such impacts identified by the <br /> Planning Director) and steps that Owner will take to mitigate those impacts. <br /> 2 3 Revision of Approved Management and Operations Plan Owner may <br /> from time to time submit to the Planning Director for approval proposed revisions to <br /> the current Approved Management and Operations Plan, which approval will not be <br /> unreasonably withheld The submission must contain an explanation for the requested <br /> revisions If the proposed revision includes staff reductions below what is contained <br /> in the Approved Management and Operations Plan,then the proposed revision(i)must <br /> be submitted to the City Planning Director no later than 60 days prior to the reduction <br /> taking effect, (u) must contain an explanation explaining how the new staffing plan <br /> will adequately serve the residents, (in) must explain whether the new staffing plan <br /> will increase impacts to the neighborhood and how any additional impacts will be <br /> mitigated <br /> Section 3 Runs with the Land <br /> This Covenant shall run with the Property and be binding on Owner and its <br /> successors including any purchaser, grantee, owner or lessee of any portion of the <br /> Property and any other person or entity having any right, title or interest therein and on <br /> the respective heirs, executors,administrators,devisees,successors and assigns of any of <br /> the foregoing <br /> Section 4 Term of Covenant <br /> This Covenant commences on the Effective Date and terminates (i) fifty (50) <br /> years after the Effective Date or(ii)the date the Property is no longer used as a Supportive <br /> Housing Facility,whichever of(i)or(ii)is later <br /> Section 5 Transfer of Property <br /> Owner shall not sell,lease or otherwise transfer the Property or any portion thereof <br /> or interest therein to anyone unless the transferee agrees in writing acceptable to the City <br /> to be bound by the provisions of this Covenant to the same extent as Owner, and the City <br /> receives a copy of the transferee's agreement prior to the transfer,but the covenants and <br /> 7 /� <br />
