Memorandum of Understanding <br /> to the Agreement by and between <br /> City of Everett <br /> and <br /> International Association of Firefighters <br /> Local No.46 <br /> This Memorandum of Understanding(MOU) amends the Trial Sick Leave Incentive Program <br /> MOU dated April 25,2018 which is supplemental to the AGREEMENT by and between the <br /> CITY OF EVERETT,WASHINGTON,hereinafter referred to as the"Employer"and the <br /> International Association of Firefighters Local#46,hereinafter,referred to as"IAFF." <br /> The parties realize that the following portion of the MOU signed on April 25,2018,outlining the <br /> agreement between the parties for a trial sick leave incentive program did not reflect the parties <br /> intent for placing sick leave cash out into the Healthcare RetirementlVEBA Account;therefore <br /> the parties mutual intent is amended below in number 2: <br /> 1. The Sick Leave Retirement Incentive Program section that reads as follows <br /> Employees shall be allowed upon retirement or death to receive Healthcare Retirement/VEBA <br /> Account funding in an amount equal to fifty percent(50%)of the value of their then existing sick <br /> leave accrual balance not to exceed the 1176 cap as identified in the labor agreement. The <br /> amount will be calculated using the employee's base rate of pay in the year of their retirement. <br /> To be eligible for this retirement funding,the employee must declare their intention to retire in <br /> writing at least 12 months prior to the anticipated retirement date. After such declaration,failure <br /> to retire at the announced date will result in the loss of 50%of the hours in the employee's sick <br /> leave bank. <br /> 2. Is hereby amended to read: <br /> Employees will receive upon retirement or death Healthcare Retirement/VEBA Account funding <br /> in an amount equal to fifty percent(50%)of the value of their then existing sick leave accrual <br /> balance not to exceed the 1176 cap as identified in the labor agreement. Except to the extent as amended herein, all provisions, <br /> which apply to that agreement and the existing MOU dated April 25,2018, shall apply to this <br /> MOU as well. <br /> Dated this of 54 2018. <br />
