(d) In the event an Agency withdraws from this Agreement, such Agency shall be <br /> entitled to receive the depreciated value of its Ownership Share in the Joint <br /> Resources. The Administrative Board has sole discretion for determining <br /> depreciated value. <br /> (e) Jointly owned Equipment may be incorporated or allocated into the funding model <br /> based upon the Ownership Shares of the owning Agencies, at the sole discretion <br /> of the Administrative Board. <br /> 6. PERSONNEL ASSIGNMENT. Each Agency shall cooperate with the Administrative Board and <br /> shall allow its assigned employees and volunteers, "Assigned Personnel", to perform the <br /> functions as delegated by the Training Chair exercising authority under this Agreement. <br /> 6.1. The Training Chair shall have the authority to determine the working location and <br /> conditions for Assigned Personnel when assigned to the Training Division. <br /> 6.2. Through the joint decision-making process as defined herein,the Agencies may be asked <br /> to fill positions or roles not currently staffed within any of the Agencies. Such <br /> assignments, if they do not create additional financial responsibilities or litigation impacts <br /> for an Agency,shall be controlled by the Administrative Board and shall not require further <br /> approval by any Agency. <br /> 6.3. Each Agency shall remain as the employer of its own Assigned Personnel and shall be <br /> responsible for establishing and paying Assigned Personnel compensation and benefits. <br /> The Administrative Board shall make recommendations and shall work with the various <br /> Agencies and bargaining units to develop uniformity in wages, benefits and working <br /> conditions. <br /> 6.4. It is understood by the Agencies that the services provided by Assigned Personnel <br /> pursuantto this Agreement will mutually benefit each Agency in proportion to the benefits <br /> received by that Agency. <br /> 6.5. The Administrative Board shall establish the chain of command for Assigned Personnel <br /> under this Agreement. However, the responsibility for hiring, evaluating, firing and <br /> disciplining Assigned Personnel shall remain with the employing Agency. An employing <br /> Agency may seek input from the Administrative Board in hiring, evaluating, firing or <br /> disciplining Assigned Personnel, but such input shall be strictly for informational <br /> purposes only, and nonbinding upon any Agency. <br /> 6.6. The Training Chair shall provide Assigned Personnel that are filling a shared functional <br /> position(s) with an explanation of roles, responsibilities, duties and expectations of the <br /> shared position(s). <br /> 6.7. To the extent this Agreement would result in any changes that affect the wages, benefits <br /> or working conditions of any represented employees, the Training Chair shall assist the <br /> governing body of the affected employing Agencies and the affected bargaining units to <br /> address such impacts prior to the implementation of the change. <br /> 7. TRAINING CHAIR. The Agency employing the Training Chair, "TCC Employer", agrees to <br /> employ and staff the Training Chair position as identified and contemplated by this Agreement, <br /> with their Training Chief or other such Chief Officer as approved by the Administrative Board. In <br /> recognition of this understanding the Agencies agree to work cooperatively in accordance with <br /> the following provisions to assist TCC Employer in maintaining its assigned Chief position. <br /> (a) The TCC Employer shall be the employer of the Training Chair. Accordingly, they <br /> shall be solely responsible for all matters related to the Training Chair's <br /> employment, including but not limited to; human resource management, <br /> Training Consortium Interlocal Agreement—Page 7 <br />
