0 <br /> 1 use of physical force against the protected person or child that <br /> 2 would reasonably be expected to cause bodily injury; or <br /> 3 (II) Includes an order under RCW 9.41.800 requiring the person to <br /> 4 surrender all firearms and prohibiting the person from accessing, <br /> 5 obtaining, or possessing fireaLius; <br /> 6 (iv) After having previously been involuntarily committed for <br /> 7 mental health treatment under RCW 71.05.240, 71. 05.320, 71.34.740, <br /> 8 71. 34.750, chapter 10.77 RCW, or equivalent statutes of another <br /> 9 jurisdiction, unless his or her right to possess a firearm has been <br /> 10 restored as provided in RCW 9.41. 047; <br /> 11 (v) After dismissal of criminal charges based on incompetency to <br /> 12 stand trial under RCW 10.77. 088 when the court has made a finding <br /> 13 indicating that the defendant has a history of one or more violent <br /> 14 acts, unless his or her right to possess a fireaim has been restored <br /> 15 as provided in RCW 9. 41. 047; <br /> 16 (vi) If the person is under eighteen g years of age, except as <br /> 17 provided in RCW 9. 41. 042; and/or <br /> 18 (vii) If the person is free on bond or personal recognizance <br /> 19 pending trial, appeal, or sentencing for a serious offense as defined <br /> 20 in RCW 9 .41.010. <br /> 21 (b) (a) (iii) of this subsection does not apply to a sexual <br /> 22 assault protection order under chapter 7. 90 RCW if the order has been <br /> 23 modified pursuant to RCW 7. 90.170 to remove any restrictions on <br /> 24 firearm purchase, transfer, or possession. <br /> 25 (c) Unlawful possession of a firearm in the second degree is a <br /> 26 class C felony punishable according to chapter 9A.20 RCW. <br /> 27 (3) Notwithstanding RCW 9.41. 047 or any other provisions of law, <br /> 28 as used in this chapter, a person has been "convicted", whether in an <br /> 29 adult court or" adjudicated in a juvenile court, at such time as a <br /> 30 plea of guilty has been accepted( (,w) ) or a verdict of guilty has been <br /> 31 filed, notwithstanding the pendency of any future proceedings <br /> 32 including, but not limited to, sentencing or disposition, post-trial <br /> 33 or post-fact-finding motions, and appeals. Conviction includes a <br /> 34 dismissal entered after a period of probation, suspension, or <br /> 35 deferral of sentence, and also includes equivalent dispositions by <br /> 36 courts in jurisdictions other than Washington state. A person shall <br /> 37 not be precluded from possession of a firearm if the conviction has <br /> 38 been the subject of a pardon, annulment, certificate of <br /> 39 rehabilitation, or other equivalent procedure based on a finding of <br /> 40 the rehabilitation of the person convicted or the conviction or <br /> 9 SHB 2473.SL <br />
