6 <br /> 1 Sec. 17. RCW 74.34.145 and 2007 c 312 s 7 are each amended to <br /> 2 read as follows: <br /> 3 (1) An order for protection of a vulnerable adult issued under <br /> 4 this chapter, which restrains the respondent or another person from <br /> 5 committing acts of abuse, prohibits contact with the vulnerable <br /> 6 adult, excludes the person from any specified location, or prohibits <br /> 7 the person from coming within a specified distance from a location, <br /> 8 shall prominently bear on the front page of the order the legend: <br /> 9 VIOLATION OF THIS ORDER WITH ACTUAL NOTICE OF ITS TERMS IS A CRIMINAL <br /> 10 OFFENSE UNDER CHAPTER 26.50 RCW AND WILL , SUBJECT A VIOLATOR TO <br /> 11 ARREST. <br /> 12 (2) Whenever an order for protection of a vulnerable adult is <br /> 13 issued under this chapter ( (,,—) ) and the respondent or person to be <br /> 14 restrained knows of the order, a violation of a provision restraining <br /> 15 the person from committing acts of abuse, prohibiting contact with <br /> 16 the vulnerable adult, excluding the person from any specified <br /> 17 location, or prohibiting the person from coming within a specified <br /> 18 distance of a location( (,—) ) shall be punishable under RCW 26.50. 110, <br /> 19 regardless of whether the person is a family or household member or <br /> 20 intimate partner as defined in RCW 26.50.010. <br /> 21 Sec. 18. RCW 9.96.060 and 2019 c 400 s 1, 2019 c 331 s 4, and <br /> 22 2019 c 46 s 5010 are each reenacted and amended to read as follows: <br /> 23 (1) When vacating a conviction under this section, the court <br /> 24 effectuates the vacation by: (a) (i) Permitting the applicant to <br /> 25 withdraw the applicant's plea of guilty and to enter a plea of not <br /> 26 guilty; or (ii) if the applicant has been convicted after a plea of <br /> 27 not guilty, the court setting aside the verdict of guilty; and (b) <br /> 28 the court dismissing thew information, indictment, complaint, or <br /> 29 citation against the applicant and vacating the judgment and <br /> 30 sentence. <br /> 31 (2) Every person convicted of a misdemeanor or gross misdemeanor <br /> 32 offense may apply to the sentencing court for a vacation of the <br /> 33 applicant's record of conviction for the offense. If the court finds <br /> 34 the applicant meets the requirements of this subsection, the court <br /> 35 may in its discretion vacate the record of conviction. Except as <br /> 36 provided in subsections (3),, (4) , and (5) of this section, an <br /> 37 applicant may not have the record of conviction for a misdemeanor or <br /> 38 gross misdemeanor offense vacated if ,any one of the following is <br /> 39 present: <br /> 5 Z. 29 SHB 2473.SL <br />
