Section 1: FINDINGS OF FACT. The "WHEREAS' provisions above shall constitute <br /> Findings of Fact and are incorporated by reference as if fully set forth herein. <br /> Section 2: INTERIM REGULATION ESTABLISHED. Paragraph G.3 of Section 5 of <br /> Ordinance No. 2923-06 (EMC 19.22.020.G.2.b),which reads as follows: <br /> 3. Non-Residential Uses. <br /> There shall be no minimum off-street parking requirement for non-residential uses in the B-3 <br /> zone. <br /> Is hereby amended to read as follows: <br /> 3. Non-Residential Uses. <br /> There shall be no minimum off-street parking requirement for non-residential uses in the B-3 <br /> zone; provided however, that Government Administrative Office uses and/or Public Service <br /> Building uses hereafter expanded or established with a gross floor area greater than 25,000 <br /> square feet shall provide a minimum of one off-street parking space per 800 square feet gross <br /> floor area. <br /> Section 3. PUBLIC HEARING. The City Council will hold a public hearing within 60 days of <br /> the effective date of this Ordinance to consider public comments on this Ordinance and to <br /> consider any requests by any interested party to revise this Ordinance. <br /> Section 4. TERM. This interim regulation will end one year after the effective date of this <br /> Ordinance unless earlier repealed or renewed according to law. <br /> Section 5. WORK PLAN. Prior to the public hearing set forth in Section 3 above,the Planning <br /> Director shall develop a work plan for the analysis of the off-street parking demands and needs <br /> in the B-3 zone related to Government Administrative Office uses and Public Service Building <br /> uses and other relevant parking issues. <br /> Section 6. SEVERABILITY. Should any section, paragraph, clause or phrase of this <br /> Ordinance, or its application to any person or circumstance, be declared unconstitutional or <br /> otherwise invalid for any reason, or should any portion of this Ordinance be pre-empted by state <br /> or federal law or regulations, this shall not affect the validity of the remaining portions of this <br /> Ordinance or its application to other persons or circumstances. <br /> Section 7. CONFLICT. In the event there is a conflict between the provisions of this <br /> Ordinance and any other City ordinance,the provisions of this Ordinance shall control. <br /> Section 8. CORRECTIONS. The City Clerk and the codifiers of this Ordinance are authorized <br /> to make necessary corrections to this Ordinance including, but not limited to, the correction of <br /> scrivener's/clerical errors, references, ordinance numbering, section/subsection number and any <br /> references thereto. <br /> 2 <br />
