17 <br /> Subj : MEMORANDUM OF UNDERSTANDING FOR LAW ENFORCEMENT SUPPORT <br /> warrant. The warrant will then be delivered at a place to be <br /> determined by the Commanding Officer and the SJA. If the arrest <br /> is made pursuant to a warrant exception EPD shall contact NAVSTA <br /> Everett Security who shall consult with the SJA to obtain <br /> permission from the Commanding Officer to effectuate the arrest. . <br /> (1) For arrests involving a military member, the <br /> arresting agency must also provide a delivery agreement as per <br /> reference (g) for any receiving jurisdiction not covered in <br /> enclosure (1) . The parties recognize that in some cases EPD <br /> might be serving an arrest warrant for a military member who is <br /> to be prosecuted by Snohomish County and/or released from the <br /> Snohomish County Jail, which is under the cognizance of <br /> Snohomish County, and that EPD does not have the ability to <br /> track the status of the military member once the member enters <br /> the Snohomish County Jail and/or is prosecuted by Snohomish <br /> County. Therefore, the parties agree that under these <br /> circumstances, the delivery agreement (enclosure (2) ) <br /> requirement will be decided between NAVSTA Everett and Snohomish <br /> County, and not EPD. <br /> (2) Arrests of civilians on board the installation <br /> shall be conducted pursuant to section 0604 (d) (2) of reference <br /> (g) . The Naval Criminal Investigative Service (NCIS) may <br /> provide the escort discussed in this topic. <br /> d. When possible, documents should be served between the <br /> hours of 0730 and 1600, Monday through Friday unless there is a <br /> concern for a victim' s safety, as in protection orders, anti- <br /> harassment orders, or any other document requiring immediate <br /> action. If service is required immediately and it is after <br /> 1600, EPD shall contact the NAVSTA Everett Security Force for <br /> assistance. <br /> e. The above procedures do not apply to out-of-state <br /> fugitive warrants.
