provides services on a fee-for-service or per-unit basis with contractual penalties if it <br /> fails to meet program performance standards. <br /> I. "Debarment" shall mean an action taken by a federal official to exclude a person or <br /> business entity from participating in transactions involving certain federal funds. <br /> J. "Director" shall mean the Director of the Snohomish County Human Services <br /> Department and/or the delegate authorized in writing to act on the Director's behalf. <br /> K. "Equipment" shall mean an article of nonexpendable, tangible personal property or <br /> information technology systems and software having a useful life of more than one <br /> (1) year and an acquisition cost of$5,000.or more per unit. <br /> L. "HIPAA" shall mean the Health Insurance Portability and Accountability Act of 1996 <br /> (Pub. L. No. 104-191, 79 Stat. 1936), as codified at 42 U.S.C. §§ 1320d-d8, and its <br /> implementing regulations set forth at 45 CFR Parts 160 and 164. <br /> M. "Nonexpendable personal property" shall mean tangible personal property having a <br /> useful life of more than one (1) year and an acquisition cost of$500 or more per unit. <br /> N. "OMB" shall mean the federal Office of Management and Budget. <br /> O. "Personal Information" shall mean information identifiable to any person, including, <br /> but not limited to, information that relates to a person's name, health, finances, <br /> education, business, use or receipt of governmental services or other activities, <br /> addresses, telephone numbers, social security numbers, driver license numbers, <br /> other identifying numbers, and any financial identifiers. <br /> P. "Personal property" shall mean property of any kind except real property. <br /> Q. "RCW" shall mean the Revised Code of Washington. All references to RCW <br /> chapters or sections shall include any successor, amended, or replacement statute. <br /> Pertinent RCW chapters and sections can be accessed at http://slc.leg.wa.gov/. <br /> R. "Real property" shall mean any interest in land, including land improvements, <br /> structures, and appurtenances thereto, excluding movable machinery and <br /> equipment. <br /> S. "Regulation" shall mean any federal, state, or local regulation, rule, or ordinance. <br /> T. -Secure Area" shall mean an area to which only authorized representatives of the <br /> entity possessing the Personal Information have access. Secured Areas may <br /> include buildings, rooms, or locked storage containers (such as filing cabinets) within <br /> a room, as long as access to the Personal Information is not available to <br /> unauthorized personnel. <br /> U. "Subcontract" shall mean any separate agreement or contract between the Agency <br /> and a Subagency to perform all or a portion of the duties and obligations that the <br /> Agency is obligated to perform pursuant to this Agreement or any Contract. <br /> V.
