Supporting Applicable Law: <br /> 1. IPMC 108.1.4 Unlawful Structure,which reads: <br /> fi <br /> An unlawful structure is one found in whole or in part to be occupied by more persons than <br /> permitted under this code, or was erected, altered or occupied contrary to law. <br /> Conclusions of Law Based on Above Findings: <br /> 1. Construction activity conducted on property within the City of Everett without required City <br /> permits is a violation of IRC R105.1. The record demonstrates said City ordinance was <br /> violated. <br /> 2. Unpermitted construction conducted on the subject property renders the accessory wooden <br /> structure unlawful as defined by IPMC 108.1.4 and is a violation of IPMC 106.1. The <br /> record demonstrates said City ordinance was violated. <br /> 3. The presence of two accessory structures within an interior side and rear setback is a <br /> violation of EMC 19.07.020 (E 1,2)and(G). The record demonstrates said City ordinances <br /> were violated. <br /> 4. The presence of a commercial shipping container on property located within a residential <br /> zone is a violation of EMC 19.7.020 (0). The record demonstrates said City ordinance was <br /> violated. <br /> ORDER <br /> Based on the findings of fact and conclusions of law stated above,it is hereby determined that <br /> the Respondents allowed violation of IPMC 106.1,IRC R105.1,and EMC 19.07.020 (E 1,2) (G) <br /> and(0) on the subject property and are hereby ordered to: <br /> 1. The Respondents must abate all violations of IPMC 106.1,IRC R105.1, and EMC 19.07.020 <br /> (E 1,2)(G)and(0)on property located at 6406 Highland Drive,Everett, Washington. <br /> 2. Abatement shall include the following: .. <br /> a. The Respondents shall remove the commercial shipping container from the residential <br /> property and zone by October 11,2019. 1 <br /> b. The Respondents shall remove the accessory wooden structure and chicken coop from <br /> the five-foot interior side and rear yard setback by October 11,2019. <br /> c. The Respondents shall apply for and obtain all of the necessary and required permits to <br /> bring the subject property into compliance with City ordinances.
