9. RCW 36.70A.390 allows the City Council to establish interim zoning controls without <br /> holding a public hearing, provided that it holds a public hearing within 60 days after the <br /> adoption of this ordinance. <br /> 10. These circumstances create a time-sensitive action requiring the use of an interim zoning <br /> ordinance establishing zoning regulations that will enable properties in Everett to be <br /> eligible for flood insurance until such time as non-interim regulations can be established <br /> following the City's normal code amendment processes. <br /> 11. The City Council finds that it is in the public interest to adopt this interim Ordinance and <br /> that such Ordinance is necessary for the immediate protection of the public health, <br /> safety, property, or peace. <br /> NOW, THEREFORE,THE CITY OF EVERETT ORDAINS THE FOLLOWING: <br /> Section 1. FINDINGS OF FACT. The Recitals set forth above are adopted as the Findings of <br /> Fact required pursuant to RCW 36.70A.390. <br /> Section 2. REPEALER. Section 3 of Ordinance No. 1847-92, as amended (EMC 19.04.030, <br /> Floodplain Overlay Zone Definitions), is hereby repealed. <br /> Section 3. REPEALER. Section 30 of Ordinance No. 1671-89, as amended (EMC Chapter <br /> 19.30 Floodplain Overlay Districts and Regulations), is hereby repealed. <br /> Section 4. Subsection 040 of Section 1 of Ordinance No. 1671-89, as amended (EMC <br /> 19.01.040), which reads as follows: <br /> Establishment of overlay zones. <br /> In certain instances, special circumstances warrant the application of special regulations or administrative <br /> processes to specific areas. In order to apply these special regulations or administrative processes, the <br /> following overlay zones are established: <br /> FWD floodway district <br /> UFFD urban flood fringe district <br /> RFFD rural flood fringe district <br /> PRD planned residential development <br /> H historic <br /> 2 <br />
