2 <br /> • <br /> SEWAGE AND ANNEXATION AGREEMENT <br /> BETWEEN <br /> CITY OF EVERETT <br /> AND <br /> SILVER LAKE WATER AND SEWER DISTRICT <br /> • <br /> This Sewage and Annexation Agreement (this "Agreement") is dated for reference <br /> purposes the 31 st day of March, 2015 ("Effective Date"), and is by and between the City of <br /> Everett, a Washington municipal corporation ("Everett") and Silver Lake Water and Sewer <br /> District, a Washington municipal corporation (the "District") (individually a "Party" and <br /> collectively the"Parties"). <br /> RECITALS <br /> A. The Parties are each authorized to operate sewer and water systems and to enter into <br /> agreements regarding water and regarding the conveyance, treatment and disposal of <br /> sewage. <br /> B. Everett and District are parties to the Agreement for Sewage Disposal dated June 16,— <br /> 1982, as amended by amendments, dated January 23, 1985; March 19, 1986; December <br /> 12, 1991; June 28, 2000; September 20, 2010; and May 15, 2012 (as amended,the "1982 <br /> Sewage Agreement"). <br /> C. Everett and the District are parties to the Agreement between the City of Everett and the <br /> Silver Lake Water District Concerning Annexations of Portions of the District to the City <br /> dated December 12, 1991 (the"1991 Annexation Agreement"). <br /> D. The Parties desire to enter into this Agreement in order to provide for sewage service for <br /> the next fifty (50) years. Except as otherwise provided below, this Agreement <br /> supersedes and replaces the 1982 Sewage Agreement in its entirety. <br /> E. During this 50 year period, the Parties also desire to enter into this Agreement to plan <br /> cooperatively for future annexations of areas within the District by Everett and the <br /> possible transfer to Everett of certain District assets and transfer of customer water and <br /> sewer service. This promotes mutual long range predictability in customer base, staffing <br /> levels, capital facility needs, water demand, sewage conveyance and treatment, and fiscal <br /> planning and viability. Except as otherwise provided below, this Agreement replaces <br /> and supersedes the 1991 Annexation Agreement in its entirety. <br /> F. Everett and the District have authority to enter into this Agreement under the provisions <br /> of RCW 35.67.300, Chapter 57.08 RCW, Chapter 39.34 RCW, Chapter 35.13A RCW <br /> and other Washington statutes. <br /> 1 <br /> 10 <br />
