.3 <br />ORDINANCE NO. <br />An Ordinance Prohibiting the Solicitation of Donations or Contributions, the Sale of <br />Goods or Services, and Other Distracting Activities near Signalized Intersections or on <br />Median Strips, Adding a New Chapter to Title 8 of the Everett Municipal Code <br />WHEREAS, the City has authority to regulate use of public rights of way, including streets and sidewalks, <br />for the public's safety; and <br />WHEREAS, the solicitation of donations, contributions, or payment for goods or services, with or <br />without signage, and other activities that by their nature require or encourage interaction between <br />pedestrians on the sidewalk, on the street, or on median strips, with drivers or passengers of vehicles on <br />the street, may create safety hazards, either by placing pedestrians in the roadway or by distracting <br />drivers from the safe operation of their vehicles; and <br />WHEREAS, prohibiting these activities will promote public health, safety, and welfare by enhancing the <br />safety of both pedestrians and drivers using public rights of way in the city of Everett; and <br />WHEREAS, the City's Traffic Engineer has determined that within 60 feet of any traffic signalized . <br />intersection is an appropriate distance to restrict these activities to better manage the safety hazards <br />addressed by this Ordinance as well as prohibiting these actives on median strips; <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1. 'The following is added as a new chapter to EMC Title 8: <br />Chapter 8.09. Activities Prohibited near Signalized Intersections and on Median Strips. <br />A. Within 60 feet of any traffic signal or on any median strip it shall be unlawful to engage in <br />activity that is intended to result in an exchange between a driver or passenger in a vehicle <br />and a pedestrian or other person not in that same vehicle. <br />Unlawful activities include but are not limited to activities that are intended to encourage <br />vehicle occupants to give money or other objects to the pedestrian or that would encourage <br />the vehicle occupant to accept money or other objects from a pedestrian. <br />B. Activities not prohibited by this Chapter include: <br />1. Pedestrian activity that is limited to providing information to persons in vehicles and is not <br />intended to encourage giving or receiving any object to or from a person in a vehicle. <br />16 <br />
