The violation citation provided a corrective <br /> action date of October 28, 2016 to abate nuisance violations on the property. A <br /> copy was posted at the property on September 28, 2016. Each method of service <br /> used is independently sufficient to provide notice. (Pursuant to EMC I.20.010.C.1) <br /> (Exhibit#4, Violation Citation dated September 27, 2016 with mail receipts) (Exhibit <br /> #5, Declaration of Service dated September 28, 2016 with photo) (Testimony of <br /> Code Enforcement Officer Fagerstrom) <br /> 7. On September 28, 2016, Officer Fagerstrom reinspected the property and observed <br /> and photographed discarded debris remained public view and the Jeep with a flat <br /> tire on a flatbed trailer remained parked outside an approved parking area on the <br /> property (Exhibit#2a-2d, Inspection Photos dated September 22, 2016) (Testimony <br /> of Code Enforcement Officer Fagerstrom) <br /> 8. On November 8, 2016, Officer Fagerstrom reinspected the property and observed <br /> and photographed that the property was substantially in compliance with City <br /> ordinance. (Exhibit#9a-9d, Pre-Hearing Inspection Photos dated November 8, <br /> 2016) (Testimony of Code Enforcement Officer Fagerstrom) <br /> 9. The City provided the Respondent with an opportunity to correct the conditions that <br /> were in violation of sections of the EMC, provided a corrective action date of <br /> October 28, 2016 and provided notice of the date, time and place of this hearing. <br /> The Respondent appeared at the hearing. <br /> Based on the above Findings of Fact, the Violations Hearing Examiner enters the <br /> following Conclusions: <br /> CONCLUSIONS OF LAW <br /> Jurisdiction: <br /> Pursuant to Chapter 1.20 EMC or any Everett Municipal Code (EMC) provisions that <br /> identify Chapter 1.20 EMC for enforcement, the Violations Hearing Examiner of the City <br /> of Everett has jurisdictional authority to hold the hearing and issue the decision. EMC <br /> §1.20.020 <br /> Applicable Law: <br /> 1, EMC 8.20.020 Nuisances,which reads: <br /> Except as authorized by subsection H of this section or as may be allowed by <br /> another city ordinance, no person owning, leasing, renting, occupying or having <br /> charge or possession of any property in the city, including vacant lots, shall maintain <br /> or allow to be maintained on the property outside of a fully enclosed structure such <br /> as a shed, dwelling, or closeable garage, any of the following conditions visible from <br /> any street, alley, or other public or private property: <br /> (A)Junk, trash, litter, boxes, discarded lumber or salvage materials or other similar <br /> materials. <br />
