The COVID-19 crisis has had a significant impact on the local economy impacting the retail, <br /> restaurant and other industries resulting in layoffs and reduced work hours for a significant <br /> percentage of this workforce and loss of income for small businesses. <br /> K. Layoffs and substantially reduced work hours will lead to widespread economic hardship that <br /> will disproportionately impact low- and moderate- income workers resulting in lost wages and <br /> the inability to pay for basic household expenses, including utility costs. <br /> L. Accordingly, the City Council desires that the Mayor be granted the authority to waive or defer <br /> utility late fees, and shutoffs. <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. For the duration of the COVID-19 Civil Emergency under Chapter 9.02 of the Everett <br /> Municipal Code and for such other duration as the Mayor may deem necessary related to COVID-19, the <br /> Mayor and her designees may on a temporary or permanent basis waive or defer late fees and similar <br /> late charges arising under Title 14 of the Everett Municipal Code, including without limitation such fees <br /> and charges under Chapter 14.32 of the Everett Municipal Code (Ordinance 585-79) and Ordinance <br /> 3529-17. All other applicable fees and charges in Title 14 of the Municipal Code shall be fully payable by <br /> the customer. <br /> Section 2. For the duration of the COVID-19 Civil Emergency under Chapter 9.02 of the Everett <br /> Municipal Code and for such other duration as the Mayor may deem necessary related to COVID-19,the <br /> Mayor and her designees may order the City to not shutoff any utility service to any customer for reason <br /> of non-payment for utility charges. This does not affect utility shutoffs for reasons other than non- <br /> payment of utility charges, such as shutoffs for illegal turn-on, tampering, maintenance or other reasons <br /> not related to non-payment. <br /> Section 3. This ordinance controls any contrary provision in Title 14 of the Everett Municipal Code. <br /> Section 4. The City Clerk and the codifiers of this Ordinance are authorized to make necessary <br /> corrections to this Ordinance including, but not limited to,the correction of scrivener's/clerical errors, <br /> references, ordinance numbering, section/subsection numbers, and any internal references. <br /> Section 5. The City Council hereby declares that should any section, paragraph, sentence, clause or <br /> phrase of this ordinance be declared invalid for any reason, it is the intent of the City Council that it <br /> would have passed all portions of this ordinance independent of the elimination of any such portion as <br /> may be declared invalid. <br /> in ORDINANCE Page 2 of 3 <br />
