Section 1: All of the real property described in Exhibit A is no longer required for City purposes, <br /> and is, therefore, declared to be surplus property. With respect to the real property in Exhibit A <br /> originally acquired for utility purposes, such real property is further resolved by City Council to <br /> be surplus to the City's needs and not required for providing continued public utility service. <br /> Section 2: The City Council authorizes the sale of the real property described in Exhibit A as <br /> follows, which the City Council deems in the best public interest: <br /> a) Properties in Exhibit A originally acquired for utility purposes shall be sold for at least <br /> 100%of the appraised fair market values stated in the Recitals above and in Exhibit A. <br /> Other properties in Exhibit A shall be sold for at least 100%of the market value as <br /> established by written independent appraisal for the property or for such other <br /> reasonable and lawful terms and conditions the City Council determines to be in the <br /> best interests of the City; and <br /> b) The City may market and list some or all of the Exhibit A properties for sale with a <br /> licensed real estate broker so long as the listing or other agreement between the broker <br /> and the City is an agreement approved by City Council; and <br /> c) Some or all of the properties may be marketed and listed for sale by City staff; and <br /> d) The disposition of the real property described in Exhibit A is to be done in a <br /> commercially reasonable manner as determined by the City's real property manager; <br /> and <br /> e) The purchase and sale agreement for each Exhibit A property will be submitted to City <br /> Council for approval prior to closing of the sale of the property; and <br /> f) The City Council reserves the right to reject any proposed purchase and sale agreement <br /> for any Exhibit A property. <br /> Count erson Introducing Resolution <br /> PASSED and APPROVED this 10 day of June , 2020. <br /> C it President °1/(A-1 > <br /> MN <br /> `RESOLUTION Page 2 of 4 <br />
