' Protection of the water,sewer and electrical utilities are required.While operating heavy equipment or storing material over City utilities.BNSF must protect City utilities with crushed rock fill or steel plates that meet City requirements and are designed and,stamped by a professional engineer.When necessary both crushed rock and steel plates will be required.The engineered designs for protecting City utilities shall be submitted to the City Utilities Superintendent for approval prior to the beginning of BNSF work. 8. City and City contractor use of the road and parking area at the west end of the road will take precedence over BNSF or BNSF contractor use of the road and parking area at all times.BNSF equipment must be moved immediately upon City request.For repairs or emergency access the City at anytime will occupy the easement(without prior notice) and the BNSF use of the easement will be suspended until City work is completed. 9. In case of a maintenance need or emergency involving City facilities,or for any other need as determined by the City,the City use and needs are superior to BNSF use of City property.This may include suspension of BNSF activities on the City property or easement and return of the full use of the property or easement to the City of Everett.Loss of service or costs incurred by BNSF as a result of City maintenance,emergencies,or need are the risk of the use of this site and - will be borne by BNSF. . 10. No parking or staging shall be allowed on City property or City easements at the areas designated as NO BNSF USE on the attached Exhibit 1.Areas designated as JOINT USE on the attached . Exhibit 1 may be occupied by BNSF or BNSF contractor vehicles,but may be required to be vacated at any time within 15 minutes of verbal notice by City personnel.No material storage or other immobile staging will be allowed on areas designated as JOINT USE. 11. Only single lane use of the road will be allowed except at the bottom and top of the roadway.No passing is allowed except at each end of the road.Coordination of traffic.on the-road shall be the responsibility of BNSF or their designee. 12.
