paving,a submittal detailing the proposed paving work shall be submitted to the CityUtilities <br /> Superintendent for review and approval. <br /> 7. ' Protection of the water,sewer and electrical utilities are required.While operating heavy <br /> equipment or storing material over City utilities.BNSF must protect City utilities with crushed <br /> rock fill or steel plates that meet City requirements and are designed and,stamped by a <br /> professional engineer.When necessary both crushed rock and steel plates will be required.The <br /> engineered designs for protecting City utilities shall be submitted to the City Utilities <br /> Superintendent for approval prior to the beginning of BNSF work. <br /> 8. City and City contractor use of the road and parking area at the west end of the road will take <br /> precedence over BNSF or BNSF contractor use of the road and parking area at all times.BNSF <br /> equipment must be moved immediately upon City request.For repairs or emergency access the <br /> City at anytime will occupy the easement(without prior notice) and the BNSF use of the <br /> easement will be suspended until City work is completed. <br /> 9. In case of a maintenance need or emergency involving City facilities,or for any other need as <br /> determined by the City,the City use and needs are superior to BNSF use of City property.This <br /> may include suspension of BNSF activities on the City property or easement and return of the <br /> full use of the property or easement to the City of Everett.Loss of service or costs incurred by <br /> BNSF as a result of City maintenance,emergencies,or need are the risk of the use of this site and - <br /> will be borne by BNSF. <br /> . <br /> 10. No parking or staging shall be allowed on City property or City easements at the areas designated <br /> as NO BNSF USE on the attached Exhibit 1.Areas designated as JOINT USE on the attached . <br /> Exhibit 1 may be occupied by BNSF or BNSF contractor vehicles,but may be required to be <br /> vacated at any time within 15 minutes of verbal notice by City personnel.No material storage or <br /> other immobile staging will be allowed on areas designated as JOINT USE. <br /> 11. Only single lane use of the road will be allowed except at the bottom and top of the roadway.No <br /> passing is allowed except at each end of the road.Coordination of traffic.on the-road shall be the <br /> responsibility of BNSF or their designee. <br /> 12.
