23. Any building or structure within 200 feet of the ordinary high water mark,in excess of 35 feet in <br /> height shall provide data showing that it will not obstruct the view of a substantial number of <br /> residences on the areas adjoining such shorelines. <br /> Response: All proposed buildings are located beyond 200 feet of the ordinary high water mark. <br /> Section 3.9 Conservation Element <br /> 1.All development activities shall comply with the City's Environmentally Sensitive Area Ordinance, <br /> EMC 19.331.360-590,in effect on March 21,2001,and Planning Director Interpretation No.2-2000, <br /> Interim Procedums,Endangered Species Act Listing for Chinook Salmon and Bull Trout;and <br /> Planning Director Interpretation No.01-005 unless more stringent requirements are adopted by City <br /> Council subsequent to that date. <br /> 3. Best available science shall be used in identifying,evaluating and mitigating impacts of <br /> development proposals. The City shall require sufficient geological,hydrological and biological <br /> studies to determine the impacts of the proposal. (See EMC 1937 and Planning Director <br /> Interpretation No.2-2000 in Appendix A.) <br /> Response: See the evaluation of the on-site wetland under RE 'Il 16-013 below. <br /> 7. All developments shall mitigate impacts to water quality using best available science. Compliance <br /> with City stormwater regulations consistent with the state stormwater regulations shall be required. <br /> Water quality monitoring during construction and operation may be required by the Planning and <br /> Community Development Director or Hearing Examiner on a project by project basis based upon <br /> specific characteristics of the proposal. <br /> Response: Ensuring stormwater regulations are met will occur with review of construction permit <br /> plans. <br /> Section 5.12 Parking <br /> 2. Parking in shoreline jurisdiction shall directly serve a shoreline use.Parking as a`primary"use <br /> and parking that serves a use not approved in the shoreline jurisdiction shall be prohibited. <br /> Response: The three off-street parking within shoreline jurisdiction serve the permitted residential <br /> use. <br /> 5.14 Residential Development <br /> 4.
