Sewer Back-Up Claim: Private Valves <br /> Ordinance History <br /> August 8, 2014 Memo (continued): <br /> • A backwater valve that is not maintained (or not correctly <br /> reinstalled after maintenance) might not close during a storm, <br /> allowing sewage into a basement. . . . Because of this, staff <br /> views City maintenance as cost effective, in view of the claims <br /> exposure. <br /> • A different approach would be for the ordinance to state that <br /> private property owners must maintain valves on private <br /> property, with City only maintaining valves in the public right of <br /> way. This is an option. But for it to work, it would need to be <br /> coupled with an ordinance provision stating that the City will <br /> reject back-up claims at properties with privately maintained <br /> backwater valves. This is because the City will no loncer have <br /> control over backwater valve maintenance, which is critical to <br /> protectinc the property acainst flooding from sewer surcharce. <br /> If this is the direction that Council desires, staff can provide <br /> further amendments to the proposed ordinance. <br />
