The City has certain construction <br /> obligations regarding the Mill Site Main Road Extension(including the Stuchell and Newland access). On <br /> the other hand,Polygon has certain construction obligations regarding public amenities(picnic shelter and <br /> access,trail realignment and intersection). Public works staff and Polygon agree that it would be more- <br /> efficient for project development if the City and Polygon swapped some of these obligations. This is <br /> primarily because it will be much easier for both parties if Polygon constructs the Mill Site Main Road <br /> Extension in conjunction with their construction on the Mill Site. The obligations being swapped are <br /> substantially equal in cost. <br /> The proposed Eighth Amendment also formalizes the extension of the deadline for the commercial <br /> development proposal from March 31, 2015 to December 31, 2015. This was previously explained in a <br /> letter to the Mayor and Council from Gary Young on behalf of the Riverfront Commercial LLC (the owner <br /> of the Landfill Site), dated March 1, 2015. <br /> Gary Young will be available to brief Council on the project status and to answer questions. <br /> RECOMMENDATION (Exact action requested of Council): <br /> Authorize the Mayor to sign the Eighth Amendment to Property Disposition Agreement, in substantially the <br /> form provided. <br /> 53 <br />
