RECITALS <br /> A. Grantor is the owner of that certain real property and improvements located in <br /> Snohomish County and legally described as follows (hereinafter called the "Grantor's Property"): <br /> LOT 22, PLAT OF "EDGEWATER", ACCORDING TO THE PLAT THEREOF <br /> RECORDED IN VOLUME 10 OF PLATS, PAGE 94, RECORDS OF <br /> SNOHOMISH COUNTY, WASHINGTON. <br /> SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. <br /> B. Grantee is the owner of that certain real property and improvements located in <br /> Snohomish County and legally described as follows (hereinafter called the"Grantee's Property"): <br /> THE WESTERLY 65 FEET OF THE SOUTHERLY 75 FEET OF LOT 23, <br /> EDGEWATER, ACCORDING TO THE PLAT THEREOF, RECORDED IN <br /> VOLUME 10 OF PLATS, PAGE 94, RECORDS OF SAID COUNTY, AS <br /> MEASURED ALONG THE WESTERLY AND SOUTHERLY LINES OF SAID <br /> LOT; <br /> THE EASTERLY 35 FEET OF THE SOUTHERLY 75 FEET OF LOT 23, AS <br /> MEASURED ALONG EASTERLY AND SOUTHERLY LINES OF SAID LOT, <br /> ACCORDING TO THE PLAT THEREOF, RECORDED IN VOLUME 10 OF <br /> PLATS, PAGE 94, RECORDS OF SNOHOMISH COUNTY, WASHINGTON; <br /> SITUATE IN THE COUNTY OF SNOHOMISH, STATE OF WASHINGTON. <br /> NOW THEREFORE, in consideration of the mutual covenants contained herein, the <br /> parties hereto agree as follows: <br /> 1. Grant of Easement. Grantor does hereby grant and convey to Grantee and its <br /> heirs, successors and assigns, for the benefit of the Grantee's Property, a non-exclusive easement <br /> for access, ingress, and egress, over, under and across the following described property for the <br /> purpose of access to the existing building currently located on Grantee's Property: <br /> THE EASTERLY 20 FEET OF THE SOUTHERLY 75 FEET OF THE <br /> GRANTOR'S PROPERTY AS SHOWN ON THE DIAGRAM ATTACHED <br /> HERETO AS EXHIBIT "1". <br /> 2. Maintenance and Liability Agreement. The responsibility for and cost of <br /> maintenance and/or repair of any improvements, and/or roadways constructed upon, under or <br /> within the easement granted herein shall be borne by the owners of the Grantee's Property, their <br /> heirs, successors and assigns.
