Because a significant amount of activity will be conducted in a significant <br /> shoreline as defined by the State of Washington (the Snohomish River) and <br /> because the proposed project will exceed the threshold amount for shoreline <br /> review, a Shoreline Permit is required. (finding 4) <br /> 3. The shoreline designations are Urban Multi-Use and Urban Conservancy. The <br /> requested uses are permitted uses within the designated shoreline districts of the <br /> subject property. (finding 5) <br /> 4. in reviewing the proposal of the Applicant, the City of Everett reviewed the zoning <br /> development requirements, including the Everett General Comprehensive Plan <br /> which designates the subject property as Waterfront Commercial and the Zoning <br /> Code which designates the subject property as Waterfront Commercial with a <br /> Planned Development Overlay. The proposal is consistent with the uses of these <br /> zoning designations and satisfies the zoning standards. (findings 3 & 14) <br /> 5. In its review of the application the City considered documentation providedithe by <br /> the Applicant that addressed the use of the subject property, the enhancement of <br /> the ecological resources present on the subject property and surrounding <br /> properties, and the impacts, if any, to the.Snohomish River and wetland systems <br /> on the subject property. Applying the shoreline regulations of the Everett <br /> Shoreline Master Program, including review of the Cultural Resources, Flood <br /> Hazard Reduction requirements, Public Access, and the Conservation Element, <br /> the proposal is consistent with these regulations. (findings 5, 7, 8, 10-12, <br /> 14-19, & 21-30) <br /> 6. The proposal has been reviewed pursuant to the Use Regulations of the Everett <br /> Shoreline Master Program. The proposal is consistent with the Use Regulations <br /> as applied to landfill and the placement of soil, sand, rock, and other materials <br /> that would create new land, tideland, or submerged lands on-site. (findings 14, <br /> 15-19 & 21-30) <br /> 7. The proposal satisfies all landfill requirements of the Everett Shoreline Master <br /> Program. (findings 15-30) <br /> 8. Because of the temporary nature of this project and the preparation of a larger <br /> future project that will provide public access to the shoreline, no public access is <br /> required at this time.
