4 oRDINANCE NO, 404 , AN ORDINANCE providing 'for the improvement of: COLBY AVENUE - from 41st Street to 52nd Street on both sides of the street, by the installation of a Mercury Vapor Street Electric Lighting System. Said system to include new aluminum poles on concrete foundations, and underground wiring, including all incidental material and work neces- sary for a complete improvement . all in accordance with plans prepared by the City Engineer. All 1 in accordance with Resolution No. 6664 of the City of Everett; creating a local improvement district; creating a local improve- ment district fund therefor; providing for the payment of said improvement by the City of Everett and by special assessment on 'j the property in said district under the mode of payment by bonds . WHEREAS, by Resolution No. 6664 of the City of Everett, the City Council has declared its intention to order the improve- ment as above outlined and doing all work in connection therewith •' to make a complete improvement in accordance with the plans and specifications prepared by the City Engineer of the City of Everett . NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That an improvement be made of: COLBY AVENUE - from 41st Street to 52nd Street on both sides of the street, by the installation of a Mercury Vapor Street Electric Lighting System. Said system to include new aluminum poles on concrete foundations, and • underground wiring, including all incidental material and work neces- sary for a complete improvement, all in accordance with plans and specifications prepared by the City Engineer and which plans and specifications are adopted and approved. Section 2: The cost and expenses of such improvement, ' including all necessary incidental expenses, shall be paid as follows : The property lying within the district shall be assessed'` and shall pay for 250 of the final costs of the improvement . All remaining costs of the improvement shall be paid by the City. The amount chargeable against the property, included in the assessment district herein created, shall be assessed against the ' property in accordance with the special benefits conferred there- on without regard to the zone and termini method of spreading assessments, but in no event in excess of the limitations above set forth. Section 3: That there is hereby established a local improvement district to be known as '`Local Improvement District ,' No. 676 , which district shall include the following described property located in Everett, Snohomish County, Washing- ' ton, to-wit:
