+ i . . . . <br /> ORDINANCE NO. 4022 <br /> AN ORDINANCE REGULATING THE ERECTION, MAINTENANCE OR <br /> CONSTRUCTION OF BARBED WIRE AND/OR ELECTRIC FENCES WITHIN <br /> THE CITY OF EVERETT: PROVIDING PENALTIES FOR THE VIOLATION <br /> THEREOF AND DECLARING AN EMERGENCY TO EXIST. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: No person shall erect, alter, extend or maintain any fence, <br /> wire or structure, within the city limits of Everett, through which an electric <br /> current shall pass for the purpose of creating and imparting an electric shock to <br /> persons or animals that may come in contact with the same; Except, that an electric <br /> fence may be installed and maintained in any area zoned A-1 Agricultural Use Zone <br /> for the purpose of controlling permitted livestock provided that no such fence shall <br /> border any public right-of-way and further provided that no such fence shall consti- <br /> tute a property line fence. Any electric fence erected or maintained in an agricul- <br /> tural zoned district shall be energized by battery power only and fence controllers <br /> shall be UL approved and so indicated. An "Electric Fence" warning sign shall be <br /> posted at not more than 100 ft. intervals. <br /> Section 2: No person shall erect or maintain any fence, within the city <br /> limits of Everett, that is composed of, or have any part of, constructed of barbed <br /> wire unless such fence is located within an area zoned A-1 Agricultural Use Zone <br /> as set forth in the Zoning Code of the City of Everett, or unless such barbed wire <br /> is placed above a woven wire or solid wooden fence, said fence to be of a minimum <br /> height of six (6) feet, for the purposes of providing an inpenetrable barrier for use <br /> around industrial properties, athletic fields, airports, electric sub-stations, <br /> storage yards, etc. <br /> Section 3: A building and/or an electrical permit shall be obtained, <br /> from the Building Department of the City of Everett, prior to erection or re-erection <br /> of any fence. <br /> Section 4: Any person, persons, companies or corporations violating <br /> any of the provisions of this ordinance by maintaining or erecting a barbed wire or <br /> electric fence within the City of Everett, as set forth by this ordinance shall be <br /> deemed guilty of a misdemeanor and upon conviction shall be punished by a fine <br /> of not to exceed $100. 00 or imprisonment in the City Jail for a period not to exceed <br /> 30 days, or by both fine and imprisonment. <br /> Section 5: The Chief of Police and/or his duly authorized representative <br /> shall be the enforcing officer of this ordinance. <br /> Section 6: That an emergency is hereby declared to exist and this <br /> ordinance shall take effect upon its publication and passage. <br /> /`/t_c t�_ / L rt '.%y - <br /> MAYOR <br /> Attest: <br /> 2-1 <br /> (City Clerk/ <br /> PASSED: JUN D) 1964 <br /> PUBLISHED: `�!"� 17 1J64 <br />
