1 <br /> CITY OF EVERETT SPECIAL PROVISIONS [Modified per Addendum #1] <br /> Any prospective Bidder desiring an explanation or interpretation of the Bid <br /> Documents, shall request the explanation or interpretation in writing by close of <br /> business three business days preceding the bid opening to allow a written reply to <br /> reach all prospective Bidders before the submission of their Bids. <br /> Supplement 1-02.4(1) by adding the following: <br /> Bidder acknowledges that he/she has not relied on representation or warranty of <br /> the City not expressly included in the Contract Documents. <br /> The information provided by the City is not intended to be a substitute for, or a <br /> supplement to, the independent verification by the Bidder to the extent such <br /> independent investigation of the Drawings and Specifications or Site conditions is <br /> deemed necessary or desirable by the Bidder. Bidder acknowledges that they <br /> have not relied upon City or Engineer furnished information regarding site <br /> conditions in preparing and submitting a Bid. <br /> Further supplement 1-02.4(1) by adding the following: <br /> 1-02.4(1)A Interpretation of Contract Documents <br /> Should a Bidder find what is believed to be discrepancies in or omissions from the <br /> Plans, Specifications, or Special Provisions, or should the Bidder be in doubt as to <br /> their meaning, Bidder may submit to the Engineer a written request for an <br /> interpretation thereof. The Bidder submitting the request will be responsible for its <br /> prompt delivery. Any interpretation of the documents, if made, will be made only <br /> by addendum duly issued and a copy of such addendum will be mailed or <br /> delivered to each Bidder receiving a set of such documents. All requests for <br /> interpretations must be received by the City or Engineer no later than 7 <br /> calendar days prior to the Proposal opening date. All questions regarding the <br /> Contract Documents shall be referred to the City or Engineer at the address <br /> provided in the Contract Documents. <br /> 1-02.4(1)B Prevailing Wages <br /> (******) <br /> Bidder is directed to 1-07.9(1) of these Special Provisions for requirements <br /> regarding applying payment of prevailing wage rates for employment of labor <br /> within Snohomish County. <br /> 1-02.4(2) Subsurface Information <br /> Delete the first paragraph and substitute the following: <br /> If the City has made subsurface investigation of the site of the proposed Work, the <br /> boring log data and soil sample test data accumulated by the City will be made <br /> available for inspection by the Bidders. The boring logs and soil sample test data <br /> shall NOT be considered as part of the Contract. In addition, the City makes no <br /> representation or warranty expressed or implied that: <br /> 1. The Bidders' interpretations from the boring logs are correct, <br /> 2. Moisture conditions and indicated water tables will not vary from those <br /> found at the time the borings were made, and <br /> 3. The ground at the location of the borings has not been physically <br /> disturbed or altered after the boring was made. <br /> Supplement 1-02.4(2) by adding the following: <br /> The boring log data and soil sample data, if any, can be found in Appendix A. <br /> If there is a geotechnical report made by the City, Bidder may contact City of <br /> Everett Project Manager to arrange to view the geotechnical report. <br /> Sewer 0 Division 1 —GENERAL REQUIREMENTS Addendum No. 1 <br /> WO No—UP3691 SP—52 May 2020 <br />
