CITY OF EVERETT SPECIAL PROVISIONS [Modified per Addendum #1] <br /> the Plans or in accordance with a particular utility's standard depth and <br /> location, Contractor shall follow the procedures of 1-04.7 DIFFERING SITE <br /> CONDITIONS (CHANGED CONDITIONS). Interference with the Work is <br /> defined as a utility that crosses or projects into the plane of the Work at an <br /> elevation between the top and bottom of the Work. <br /> 1-04.2 Coordination of Contract Documents, Plans, Special Provisions 1 <br /> Specifications, and Addenda <br /> Revise the second paragraph of 1-04.2 to read as follows: <br /> Any inconsistency in the parts of the Contract shall be resolved by following this order <br /> of precedence: <br /> 1. Change Orders, ' <br /> 2. Addenda, <br /> 3. Contract, <br /> 4. Proposal Form, I <br /> 5. Special Provisions, <br /> 6. Contract Plans, <br /> 7. City's Standard Drawings (if any) <br /> 8. WSDOT/APWA Standard Specifications for Road, Bridge, and Municipal <br /> Construction, , <br /> 9. Amendments to WSDOT Standard Specifications for Road, Bridge, and <br /> Municipal Construction, and <br /> 10. WSDOT/APWA Standard Plans for Road, Bridge and Municipal Construction. ' <br /> Revise the seventh paragraph of 1.04.2 to read as follows: <br /> In case of any ambiguity or dispute over interpreting the Contract, the Engineer's <br /> decision will be final as provided in 1-05.1 AUTHORITY OF THE ENGINEER. <br /> 1-04.3 Reference Information <br /> Revise 1-04.3 to read as follows: <br /> Reference Information provided to the Contractor is not part of the Contract. The City <br /> of Everett does not guarantee the accuracy of the Reference Information and is not <br /> responsible for the content of the Reference Information in any manner. Any use of <br /> Reference Information by the Contractor is done solely at the Contractor's risk. <br /> 1-04.4 Changes <br /> Delete 1-04.4 and substitute the following: ' <br /> 1-04.4 Changes <br /> 1-04.4(1) City's Right to Direct Changes to the Work <br /> (******) <br /> The City reserves the right to change the Work at any time. Such changes shall not <br /> invalidate the Contract nor release the Surety, and the Contractor agrees to perform <br /> the Work as changed. Among others, these changes and alterations may include: <br /> 1. Deleting or omitting any part of the Work, Equipment or material to be <br /> provided under this Contract, <br /> 2.
