1 The DBE may lease trucks from a truck leasing company (recognized truck I <br /> 2 rental center), but can only receive credit towards DBE participation if the DBE <br /> 3 uses its own employees as drivers. I <br /> 4 <br /> 5 DBE Manufacturer and DBE Regular Dealer <br /> 6 One hundred percent (100%) of the cost of the manufactured product obtained 1 <br /> 7 from a DBE manufacturer can count as DBE participation. If the DBE <br /> 8 manufacturer is a UDBE, participation may count towards the UDBE COA Goal. <br /> 9 1 10 Sixty percent (60%) of the cost of materials or supplies purchased from a DBE <br /> 11 Regular Dealer may be credited as DBE Participation. If the role of the DBE <br /> 12 Regular Dealer is determined to be that of a Broker, then DBE credit shall be <br /> 13 limited to the fee or commission it receives for its services. Regular Dealer ' <br /> 14 status and the amount of credit is determined on a Contract-by-Contract basis. <br /> 15 If the DBE regular dealer is a UDBE, participation may count towards the UDBE <br /> 16 COA Goal. I <br /> 17 <br /> 18 DBE firms proposed to be used as a Regular Dealer must be approved before <br /> 19 being listed as a COA/used on a project. The WSDOT Approved Regular Dealer I <br /> 20 list published on WSDOT's Office of Equal Opportunity (OEO) web site must <br /> 21 include the specific project for which approval is being requested. For purposes <br /> 22 of the UDBE COA Goal participation, the Regular Dealer must submit the I <br /> 23 Regular Dealer Status Request form a minimum of five calendar days prior to <br /> 24 bid opening. <br /> 25 I 26 Purchase of materials or supplies from a DBE which is neither a manufacturer <br /> 27 nor a regular dealer, (i.e. Broker) only the fees or commissions charged for <br /> 28 assistance in the procurement of the materials and supplies, or fees or <br /> 29 transportation charges for the delivery of materials or supplies required on a job , <br /> 30 site, can count as DBE participation provided the fees are not excessive as <br /> 31 compared with fees customarily allowed for similar services. Documentation will <br /> 32 be required to support the fee/commission charged by the DBE. The cost of the I <br /> 33 materials and supplies themselves cannot be counted toward as DBE <br /> 34 participation. <br /> 35 I 36 Note: Requests to be listed as a Regular Dealer will only be processed if the <br /> 37 requesting firm is a material supplier certified by the Office of Minority <br /> 38 and Women's Business Enterprises in a NAICS code that falls within I <br /> 39 the 42XXXX NAICS Wholesale code section. <br /> 40 <br /> 41 Underutilized Disadvantaged Business Enterprise Utilization I <br /> 42 The requirements of this section apply to projects with a UDBE COA Goal. To be <br /> 43 eligible for award of the Contract, the Bidder shall properly complete and submit an <br /> 44 Underutilized Disadvantaged Business Enterprise (UDBE) Utilization Certification <br /> 45 with the Bidder's sealed Bid Proposal, as specified in Section 1-02.9 Delivery of I <br /> 46 Proposal. The Bidder's UDBE Utilization Certification must clearly demonstrate how <br /> 47 the Bidder intends to meet the UDBE COA Goal.
