STAFF REPORT TO CITY COUNCIL <br />ON THE PROPOSED VACATION OF <br /> <br />the north-south alley together with the southern east-west alley in the 2900 Block lying between <br />Pine Street and Maple Street. <br /> <br /> <br />July 21, 2020 <br /> <br />The proposed vacation area is legally described as: <br /> <br />The alley lying within Block 695 Everett Land Company’s First Addition to Everett, <br />according to the plat thereof recorded in Volume 3 of Plats, Page 20, records of <br />Snohomish County, Washington; Together With; The alley lying westerly of lots 27 <br />through 30, inclusive; and lying easterly of lots 11 through 14, inclusive, all in Block 695 <br />Swalwell’s Second Addition to Everett, according to the plat thereof recorded in Volume <br />3 of Plats, Page 11, records of Snohomish County, Washington. <br /> <br />Situate in the Northwest Quarter of the Northeast Quarter of Section 29, Township 29 <br />North, Range 5 East, W.M.; and The Southwest Quarter of the Southeast Quarter of <br />Section 20, Township 29 North, Range 5 East, W.M., City of Everett, Snohomish <br />County, Washington. <br /> <br /> <br />The proposed alley vacation contains a total area of approximately 17,718 square feet that is <br />zoned UM – Urban Mixed within the Metro Everett Area. The proposed use is for the <br />consolidation of adjacent properties to create an overall contiguous site of approximately 3.7 <br />acres for future expansion of Kaiser Permanente facilities. <br /> <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW: <br /> <br />FINDING: R.C.W. 35.79.010 allows property owners abutting a public right-of-way to <br />petition for the vacation of said right of way, and if said petition represents <br />more than two-thirds of the property abutting said right of way, the legislative <br />authority shall by resolution fix a time and date for said petition to be heard. <br /> <br />CONCLUSION: A valid petition of the abutting property owners was received, and on July 8, <br />2020, Everett City Council adopted Resolution 7537 setting August 5, 2020 at <br />6:30 P.M. as the date and time for said petition to be heard. <br /> <br />FINDING: R.C.W. 35.79.020 requires the City Clerk to give a minimum of twenty (20) <br />days notice of the pendency of said hearing on the petition by written notice <br />posted in three (3) of the most public places in the City, and a like notice to be <br />posted in a conspicuous place on the right of way proposed to be vacated. <br /> <br />CONCLUSION: Said notices were posted as required. <br />
