City of Everett 00 6800 - 2
2020 Trickling Filter Media Replacement UP 3742-2
2. For all hours worked in any given week if they perform manual or physical
labor for fifty percent or more of their hours worked on a public works project
during such week.
1.3 SUBCONTRACTORS
A. The Contractor shall include the apprentice utilization requirements of this
Specification 00 6800 in all subcontracts executed for the Project, and ensure
that all subcontractors working on the Project are notified of the apprentice
utilization requirements. The Contractor is responsible for using good faith efforts
to meet the apprentice utilization requirements of the Contract, including overall
compliance on all contract labor hours worked by subcontractors.
1.4 CHANGES TO THE APPRENTICE UTILIZATION REQUIREMENT
A. If the Contractor determines during the term of the Contract that it will be unable
to meet the apprentice utilization goal, the Contractor must ask the City in writing
to modify the goal. The request shall include documentation of the Contractor's
affirmative efforts to use apprentices registered with the Washington State
Apprenticeship and Training Council ("SAC"), including copies of
correspondence between the Contractor and the SAC approved apprentice
programs, union locals, FAST Jobs Coalition, and others.
B. Bases for modification of goal include, but are not limited to:
1. A lack of availability of apprentices;
2. A disproportionately high ratio of material costs to labor hours, which does
not make feasible the required minimum levels of apprentice participation;
3. Participating contractors have demonstrated a good faith effort to comply
with the requirements of this resolution; or
4. Other criteria deemed appropriate by the City in its sole discretion.
C. The City shall evaluate the request, and if appropriate, a change order shall be
prepared by the City authorizing modification of the apprentice utilization goal. If
the City determines that a modification is not justified, the City shall communicate
the decision in writing to the Contractor.
1.5 MONTHLY APPRENTICE UTILIZATION REPORT
A. With each Request for Progress Payment, the Contractor shall submit to the City
a Monthly Apprentice Utilization Report in an electronic format to be provided by
the City, for the Contractor and all subcontractors. The Contractor and all
subcontractors performing work on the Project during the reporting period shall
00 6800 - 2 APPRENTICE UTILIZATION AND REPORTING
