Cable Franchise <br /> Dear Mr . Cooper : <br /> This is to advise you in order <br /> that you might inform the City Commissioners, that T .V. <br /> Cable is willing to accept a renewal of its present franchise <br /> on the basis that it will be given a franchise as published <br /> with the following amendments and exceptions, to-wit : <br /> 1 . That the term of years of the franchise be <br /> limited to ten ( 10) ; <br /> 2. That the compensation to be paid under Section 8 <br /> of the franchise be increased from 2% to 3%; <br /> 3. That said compensation be payable quarterly by <br /> T .V . Cable without prior billings by the City <br /> of Everett; <br /> 4. That the following paragraph be added to Section 8 <br /> of the published franchise Ordinance: <br /> " It is further agreed that grantor may reopen <br /> for negotiation the question of increase of <br /> grantor ' s compensation hereunder, provided: <br /> That such reopening be communicated to grantee <br /> in writing at least sixty (60) days prior to <br /> the third, sixth and ninth anniversary dates <br /> of this franchise, or else be deemed waived; <br /> that no increase shall be demanded of the grantee <br /> by the grantor that is unreasonable in comparison <br /> to similar franchise charges levied by cities in <br /> the State of Washington upon television cable <br /> companies similarly situated as is the grantee <br /> herein; in the event grantee deems grantor ' s demand <br /> for increase of compensation to be unreasonable, <br /> it may test the reasonableness thereof to the same <br /> extent and in the same manner as is provided to <br /> grantee in Section 6 hereof.' <br />
