Exhibit C <br /> DEVELOPMENT AGREEMENT <br /> THIS AGREEMENT is entered into this /3 t day of .6eceiyi x -2007, by and <br /> between Our Savior's Lutheran Church (hereafter the "Church") and the City of Everett, a <br /> municipal corporation under the laws of the State of Washington (hereinafter the "City"). <br /> RECITALS <br /> A. The Church owns approximately 5 acres of real property (map attached) located at <br /> 215 Mukilteo Boulevard (hereafter the "Property"). Upon implementation of this Agreement the <br /> zoning will be B-2 (Exhibit A) subject to property use limitations found herein with sign <br /> configuration (Exhibit B) and functional considerations, depictions and descriptions found <br /> herein. <br /> The Church's desire is to install an electronic, illuminated changing message sign in a <br /> permanent sign currently installed on the property. Signs such as that described here are allowed <br /> in the requested City B-2 (Commercial Business) zone, but not in the R-1 (Single Family) zone <br /> that existed on the property prior to the effective date of the passage of the Ordinance <br /> establishing B-2 zoning on the property, combined with the execution of this Agreement. <br /> The Church herein states, as evidenced by willingness to sign this Agreement,that <br /> Church officials in general and signers of this Agreement specifically, have examined the terms <br /> of this Agreement and are comfortable and committed, in letter and in spirit,to follow through <br /> with these obligations and commitments, with only minor changes, as defined herein. And that <br /> such actions are recognized as being both in the best interests of the Church and the affected <br /> community. <br /> 1 <br />
