N <br /> on Sultan River this protest is based up n.the following reasons. <br /> Eiret The Sound fewer Company has failed to comply in any <br /> particular with the Lave e£the State of Washington relating to the <br /> appropriation of the waters of the Sultan Five_and has not 1 pally <br /> appropriated e h waters. <br /> Second Tha. u <br /> a the temporary permit'nae granted t <br /> Sound Power Company on Sune <br /> 23,1922,nor for a longtime <br /> e prior thereto <br />• has the Sound Power Company prosecuted its work i good faith or done <br /> any development work of any hand and in fact since said date no money or <br />• <br /> labor has been e..ended be the Sound Power Corspary in the development <br />• <br /> of its power project on the Sultan Paver and said company has completely <br /> failed to diligently pursue the work outlined in its app cation for it <br /> temporary permit. <br /> Third TF.et in the course its normol Growth and development <br /> the city of Everett will require for domestic purposes,all of the waters <br /> Cf the Sultan River; that already such city haspanded in the develop- <br /> ment of lte municipal water system on the Sultan River In excess of <br />• $600,000.00 and within the immediate future expects to e_end a further <br /> sum an the development of such eater eystem and in the construction of a <br /> new pipe line from the Sultan River to the City of Everett,approximately <br /> $100,000,000.00. <br />• <br /> Fourth That the City o£Everett hie under and pursuant to <br /> the^Water Code"of the State o£Washington,appropriated the wetcrs <br /> of the Sultan River for domestic uses. <br /> Fifth That should the Sou.la Power Company divert water from <br /> the Suiten River,necessary to develepe the power project covered In its <br /> 0emporary permit from the Federal Power Cosi asfon,there wi11 remain <br /> insufficient water for the domestic purposes of the City of Everett. <br /> Sixth: Should the Sound Power Company proceed to develops its <br /> Power Pro.act in accordance with its apllieation to the Federal Power <br /> Commission and in connection therewith to flood the shore lands of the <br /> Sultan Has1n,the domeetie water supply of the City of Everett would <br /> become contaminated,u potable and rendered unfit ler human Consumption; <br /> that the water could become surcharged with all moria of vegetable <br /> S�niAsn�eal eae,n of the submerging of the vegetable growth in the <br />
