<br /> WHEREAS,the City of Everett heretofore,to-wit:On the 24th
<br /> • day of December,1936 entered into a certain oxitten contract with
<br /> ; .'Westrn Pipe 8 Steel Company of California, California corporation,
<br /> for the co truotioo of a pipe line,said work being known es Section 1
<br /> 2 hnd 3 of Sultan River Pipe Line Projeot No.3,said contract being in
<br /> the original amount Of$1,259,368.90;and
<br /> WHEREAS,through no fault of the contactor there remains in-
<br /> cident to said contract a wall amount of clean-up work,which clean-
<br /> up work the City•of Everett,by reaeon of weather end soil conditions,
<br /> • ' deems it Inadvisable end unwise to complete at the present time;and
<br /> •
<br /> Wfffii8A3,said original contract is eubetaatlally completed and
<br /> all work thereunder performed,with the exception of said emll mnount
<br /> of clean-up work,and ready for acceptance,and said pipe live is now
<br /> . being used by'the City of Everett.

<br /> NOW,TPBRd.PORE,BE IT RESOLVED that,subject to the approval of
<br /> • Pu83 Works Administration,said contract between the City of Everett
<br /> Co
<br /> and said Western Pipe&Steel Company of California,a California
<br /> corporation,bearing data of December 24th,1936,covering the construe-
<br /> " • tion of a pipe line,oa10 work being known as Section 1-2 and 3 Sultan
<br /> River Pipe Line Project No.3,be,end the same is hereby declared cora-
<br /> •
<br /> . plated,and said work and maid eontraot Soo pled by the City of Everett;
<br /> • provided,however,that there shall be retained from the eye and
<br /> tamed percentage due to said'Western Pipe 8 Steel Company the sum
<br /> of$10,000.00,to insure the completion of said clean-up work,end such
<br /> liens which may be filed against said job prior to the expiration ed of
