Thus,legally the City should not provide any official <br /> name of street in that area. Mx.Hendricks frxthes stated that City officials <br /> in the past have assigned the new•Sharon Crest Drive to the streets in <br /> this unplated area because of the general usage and acceptance of such <br /> designation for many years. Such street designation for this area is <br /> also on most City maps. To permit another street name to be officially <br /> designated for a portion of this area would compound the present legal <br /> concerns already existing regarding the Sharon Crest area. Mr.Hendricks <br /> also stated that to prevent the further entangling of legal problems in <br /> this area,he must take an official position that the City staff can only <br /> provide en address designating the street as Sharon Crest Drive. <br /> Mr.Hendricks further stated that the only way this matter can he legally <br /> resolved is by the official platting of this area with tAe appropriate <br /> dedicating and naming the streets within.such Plebe,but until such <br /> process is pursued,he feels we have no alternative other than to specify <br /> that the address in this area be designated as Sharon Crest drive with <br /> the appropriate street number. <br /> Council President%inch Raked Mr.Hendricks if it would be illegal for <br /> the City to designate that street as Westmare by ordinance because it is <br /> a private road, <br /> Al Hendricks stated he did not feel this is a legal action. <br /> Roll was called on the motion to grant the request of Mrs.Baxgreen with <br /> all Councilmen voting yes,except Councilman Gipson and Rucker who were <br /> • excused and Councilman Minch who voted no. <br /> Motion Carried <br /> • <br /> WHSTERRA REPORT <br /> Allen Hendricks stated that the issue here is whether the City is obligated <br /> • <br /> te pay the extra cost for shipping trees. mr.Hendricks stated that it was <br /> his opinion that according to contract,the City is not obligated to pay <br /> Westerra extra compensation.for shipping trees. <br /> CounclImanginchm=e2..Writ:entf,icksnatTattcntrleIll:iity.Council has <br /> gtletttis:s'1.:Y.Tre;:dht=9:14:r:hlarlise <br /> acceptance of jobs as complete. <br /> Councilman Aldcroft asked for an update on.e eltuatien by text <br /> Wednesday. <br /> • <br /> • <br />
