[ 312 <br /> August 2,1978 <br /> • WHEREAS,Emergency Services has in its possession,numerous items of <br /> Personal property;and <br /> WHEREAS,the Everett-Parks and Recreation Department has a need for such <br />,• <br /> equipment in order to implement their park programs;and <br /> WHEREAS,the Everett Parks and Recreation Department and other depart- <br /> ments within the City may have a need for some of the personal propertY <br /> in the possession and custody of Emergency Services;and <br /> WHEREAS,Emergency Services finds such usage bY the CitY both a *8. <br /> and consistent with their use of the personal property. <br /> NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT <br /> • <br /> • <br /> that this City is hereby authorized to utilize said personal property <br /> ..a the Mayor shall be authorized to approve or disapprove the use of <br /> any additional personal prmperMy which is on loan to Emergency Services. <br /> In authorizing this,the City Council is cognizant of the following <br /> conditions: <br /> • <br /> 1. The regal owner of this personal propertY in the U.S.Geyer), <br /> ment and the registered owner is Emergency Services. <br /> 2. The property is at the City's disposal on a temporary basis. <br />• <br /> If a disaster should arise and Emergency Services determines <br /> they have a need for the equipment,they will recall it. <br /> The City must relinquish it immediately. <br /> 3. The property is on loan to Emergency Services for a five(5) <br /> year period. At the expiration of that date,the U.S. <br /> Government may terminate the loan of the property to Emer- <br /> genCY Services,or renew it for another period. If the- <br /> loan is terminated,title will vest in Emergency Services <br /> and they will either recall the property or if it still serves <br /> 1.1 an emergency purpose,allow it 53 335335 with the local agency. <br /> 4. The City is responsible for returning the property in as good <br /> ) a condition as when received,excepting normal wear and tear. <br /> 5. The City is responsible for the maintenance of tne property <br />, and must make it available for inspection by Emergency Services. <br /> • <br /> 6. The City may not profit by the use of the personal property. <br /> This Tsahs chat the personal property may not be...a <br /> any revolving funds. It also means that no depreciation ex- <br /> I vnnse may be taken,only cost of maintenance.- <br /> 7.
