He feels he had been unjustly treated by the <br /> City in terms of the system development fee assessment. Like many other <br /> citizens,he was in the middle of the short plat process when the. <br /> • <br /> ordinance was adopted and,like other citizens,he is nOW aSSeSsed a <br /> substantial amount which in all probability he had not foreseen. To <br /> compound the impact,Mr.Landon's short plat is located in the South <br /> Everett area which carries the highest assessment established by the <br /> ordinance. <br /> Brad Cattle,City.Attorney,said the ordinance does not provide for an <br /> appeal of this fee. de felt the only reason the Council could use for <br /> approving this waiver would be that the City had caused the delay for <br /> the approval of the short plat. He said he had checked into this and <br /> COuld find no record of any delay caused bY the O., These hid bee.. <br /> problem with the State of Washington regarding drainage. He felt the <br /> ordinance should not be enforced in a discriminatory fashion. He sug- <br /> gested that perhaps the ordinance should be amended establishing some <br /> rules and regulations as to how a fee could be waived. <br /> Mayor Moore said the city had been negotiating with the State because of <br /> the drainage problem off I-5. This was in the area of Mr.Landon's <br /> - Property. This problem took approximately one year to solve,.which <br /> delayed Mr.Landon's short plat. <br /> Mr.Landon said the Engineering Department had approved a short plat <br /> on Lots 1 and 2,but the 3rd lot had to be drained before they would <br /> aPprove this. This was Prior to the new ordinance. He wanted to get <br /> the drainage completed before he did the short plat and so had not <br /> continued with it. J. <br /> Moved by coun,ilman Aldcroft,seconded by Councilman Micheison,to <br /> authorize Ne Cliff Landon short plat be exempt from payment under <br /> orRinswce 2.-$0,the Systems Development Fee Assessment ordinance, <br /> in the amount of$2,148.00 because of the excessive delay cauSed,y the <br /> State of Washington and was brought to their attention by the Mayor of <br /> - the City of Everett,explaining and out/ining an inadequate drainage <br /> system and the finalization of this was delayed to the extent that it <br /> in turn delayed the Landon short plat Lots 1 and 2 unnecessarily. <br />
