danuary 25,1984 <br /> 1%81.1 <br /> she said if staff hes been misinterpreting the ordinance <br /> in this and/or other rezones,they would need direction <br /> for future applications. <br /> Councilman Overstreet asked if the applicant objected to <br /> this condition before and Mr.Ervine said he did think the <br /> issue had been raised previously but the applicant had <br /> addressed this in the January 7,1983,memorandum in <br /> support of application for rezone. <br /> Ms.Strong then distributed a drawing of the Bolger site <br /> which was designated.Exhibit A.. <br /> , <br /> Thomas P.McCormack,of 5616 Fleming,spoke of the large <br /> trailers loading and unloading,the noiee and smell of <br /> diesels left running,and difficulty to turn around on <br /> Fleming by large vehicles. He then <br /> called upon Jerry Bois.to speak. 111,11';';,1 <br /> Jerry Holser,of 3631-121st St.N.E.,Marysville,said <br /> the area of the property to be rezoned from R-2 to B-2 <br /> would be used for storage of tires and 55 gallon drems of <br /> recap materiale. The remainder of the property on Fleming , <br /> will continue to be rental properties as restricted by the <br /> agreement. He did not feel there would be any change in <br /> traffic volumes. He then pointed out the problems that would <br /> arise wi.parking if the improvements were installed on , , <br /> Evergreen Way. <br /> Councilman Overstreet asked Mr.Bolser if he had participated , <br /> in the Evergreen Way Study or if he was aware of the study <br /> and he replied no to both questions. <br /> Mr.Ferguson said they would be willing to grant a power of <br /> attorney for an LID on Evergreen Way. However,if Council ' <br /> chose to impose the condition regarding full street improve- <br /> fu <br /> ments,he felt they would be acting in excess of their lawl <br /> authority and suggested that his client would euffer damages <br /> which they would use legal means to recover. <br />
