I 1
{
mayor Moore then asked Mr,Gregoire if the Planning Department would
I please work with the county on the sane type of ordinance-because of '
1 possible annexations.
Gail Chism,of 4601,So.4th,pointed out that Kill Creek had put a
moratorium on that type of business being conducted in their city
and questioned why this ordinance was being prepared instead of
' doing the sane heDst, .She said the Lowell Plan called for tighter
control on new development and she felt haVing this type of business
did not fall into good development.
Jim Iles, Assistant City Attorrmy, said the City of Everett is
dealing in more than just strictly the zoning iasue. In checking
into this, this was an enfringement on the first amendment of the
Constitution and be felt that the City could not put a moratorium on
, this type of business. The zoning regulation was the best solution.
Councilman pope asked ms.chism if she felt the council was adopting ':
, this ordinance to encourage this type of business to come in to the
5 City, and me.Chism replied she felt it certainly helped.
P 711NUrChe'ePrerirg="th:ttY'Ymog°111:'tolgiel:Ig=w:g -
I shouid happen and the citiZens would be involved in this.
p Carol Lively,of 4301 So.3rd,felt the public should be allowed to
, vote on whether the citizens wanted this type of business in the •
city. .
, Mayor Moore said the ordinance was written not to place it at the ',1,7
location designated now,but to restrict it from all single family
R hOmes, etc. and this area was the only area that fell under the '',4
Specifications of the ordinance.
til
Mike Holtzinger, pester of the Valley View Baptist Church, said
their attorneys were fearful that this new area might be too small.
He urged the Council to read the proposed resolution he had asked to
be prepared and ask other citien to support Senate Mill 4072
relating to pornography and moral nuisances.
I4
!PI.,
