Ele recommended that Council use its legal authority in • <br /> providing controls and Iegulations on these businesses but not enact <br /> CCC 1881818)ill which may jeopardise the licensing provisions. He <br /> recommended that the zoning issues be left for additional study and <br /> review. <br /> • <br /> Sarah France,Chairperson of the Adult Use Committee, reViewed the <br /> process that the committee followed which included in-house study,- <br /> eXpert testimony, field trips, and public forum. It is the <br /> consensus II the committee to rectumtd the adoption of the two <br /> ordinances as presented. With this legislation,it gives the City <br /> gOod position to deal with these issues. The adoption of these <br /> ordinances will give enforcement capabilities. <br /> .• <br /> Keith Wilson, Attorney end Adult Use Committee member, stated his <br /> support for the adoption of these ordinances. The ordinances must .• <br /> meet the requirements of the court interpretation of constitutional <br /> rights of the individuals in order to a an effective-tool for <br /> control of these businesses. The City is preempted by state law <br /> regarding the 18 year old requirement. This is a step by step <br /> process and the adoption of these ordinances are a good foundation <br /> for control, regulatiOn and enforcement of these types of adult <br /> activities. <br />
