Review Board. <br /> . • • <br /> . poll was called with all councilmen voting yes except President <br /> Gipson who was excused. <br /> .• <br /> Motion carried. <br /> FORMIC SEARING-APPEAL <br /> Bob Landles said in June of 1987, he discussed with Mr. Bhend the <br /> possibility of culverting a tribUtary to vamp Creek on his property <br /> east of 18th Ave.W. At that time, Mr. Bhend was informed that a <br /> SEFA environmental review would be required and that he should <br /> contact the Department of Game to see if they had any concerns about <br /> the proposal. <br /> In August of 1987, Mr. shend received a Hydraulic Project Approval <br /> (HPA)from the Department of Game to culvert the stream and relocate <br /> a wetland area. The SPA indicated that the project was exempt from •I <br /> SEMI. So fact,the project as proposed by Mr.Bhend was net exempt <br /> from SEPA. He said the SPA has since been rescinded by the <br /> Department of Game,and referred to Exhibit 11 in the packet. • <br /> On August 12, 1987, Mr. Bhend submitted an application for a SEPI • <br /> environmental review for the placement of 180 feet of 30"culvert in <br /> a tributary to Swamp Creek and grading of about 50100 cubic yards of <br /> earth to fill this area. <br /> rl <br /> On August 14, 1987, the City issued a Determination of <br /> Non-Significance for the proposal. During the ensuing 15-day public ,I <br /> comment period, the City received telephone calls from the <br /> Department of Ecology which led us to do further analysis on the <br /> ' Proposal. <br /> After further discussions among City Staff and the State Departments <br /> of Wildlife and Ecology, and after several meetings with the <br /> applicant, the City issued a Revised Mitigated Determination of <br /> • <br /> Non-significance on September 25,198). <br /> r•: An appeal of that determination was submitted by the applicant,Marc <br /> Shand. The ferules appealed relate to conditions placed by the City <br /> which reatrict the length of culvert to that necessary to provide <br /> r reasonable access to development on the east side of the stream. <br /> • Re then referred to the findings and conclusions including the • <br /> Drainage Basins Plan, SEPA ordinance, annexation documents and <br /> .. Previous Snohomish County action, the Comprehensive Plan and the <br /> General Policy. <br /> • <br />
