PUBLIC HEARING-EVERGREEN FUNERAL HONE APPEAL President Silva said this was a public hearing to consider the appeal o/ the Evergreen Funeral Home's request for reconsideration regarding a Special Property Use permit for a proposed crematorium. She said staff would make a presentation, the council would ask questions end the appellants would then speak. Nary Cunningham of the Planning Department, said Evergreen Funeral Home is aggrieved by the HearingExaminer's decision of April 15, a'3 1988 which denied the motion far reconsideration of his earlier decision o/March 21,1988. The decision denied a Special Property �' Use permit far Evergreen Funeral Home to construct crematorium, based on the Pact that there was environmental impact but that p I; the applicant plicant did not demonstrate no [public need for the li I� The applicant contends that en error-in-fact and a r pr-in-law jI, exists in the record of the Hearing Examiner's decision. The applicant requests that the City Council reverse the examiner's 1�' conclusion 6, reverse the Hearing Examiner's decision end direct I, approval of SPU 62-138 subject to the conditions recommended by the Planning Department.
