November 30,1988 497 <br /> Blair Burroughs, Special LID Counsel, stated the major property <br /> owners have agreed to accept the revised assessment roll and if the <br /> City contributes the additional$333,234 to the project, they will <br /> present,aitten waivers of their right to protest LID 717. <br /> Moved by Councilmember Overstreet,seconded by Councilmember Pope to <br /> authorize the expenditure of $333,234 from half cent ges tax <br /> moraesto LIO 717, 4th Avenue West project, contingent upon receipt <br /> of waivers to right to protest from the major land owners. <br /> Roll was called with all councilmembers voting yes. <br /> Motion carried. <br /> Mr.Burroughs entered Waivers of Right to Protest from the following: <br /> Exhibit 16 lgned Waiver <br /> i <br /> Exhibit 17 Spieker Partners <br /> Exhibit 18 Glacier Lanes <br /> Exhibit 19 Roses,Int.Inc. <br /> Exhibit 20 Terra Firma Oevelopment r I <br /> Exhibit 21 Haines <br /> Charles Macauley,Appraiser of 610 Medical Dental Building,reviewed <br /> the special benefit attributable to the Nyhus property. In the <br /> course of the special benefit study of the Southpoint LID sees en n: Lo;t " g21. ,et <br /> V :s his understanding <br /> rea <br /> on the relationship of his property to the property to the North. <br /> It is comprised of a strip of homes,on single tracts,and modest, <br /> well maintained homes. The land values have increased Out to the <br /> changes in the area from residential to commercial. <br /> The Nyhus ownership consists of two lots,one with the home and one <br /> vacant with roughly 16,000 square feet, compared to approximately <br /> 8,000 square feet in the single family tracts to the North. The <br /> result is that his assessment is not only high in grass due to the <br /> larger land area,but he does not have the detraction of the house <br /> an one of his parcels. The Nyhus property is also closer to the <br /> corner than the other properties. <br /> Some of the properties to the south have already been converted to <br /> commercial use or are in the process. Mr. Macaulay Stated in his <br /> opinion the assessment is fair,it is less than the special benefit <br /> to the property, and it is in proportion to the other recommended <br /> assessments in the COO area. <br /> Hosed IC,cafttmg:Ilfn:fpe,seconded by Councilmember Stephenson to <br /> President Niva asked if anyone else wished to speak and no one <br /> replied. <br /> Motion carried. <br />
