January 17,1990 13 .1yI1 <br /> PUBLIC HEARING-MERRILL CREEK REZONE <br /> 1 <br /> President Pope opened the hearing on the proposed rezone from R-5 <br /> N <br /> and R 1 to 3(A) zone of property lying west of Glenwood Ave. and <br /> north of Merrill Creek Parkway and said the council members.had a a <br /> copy of the Planning Commissions Findings and Conclusions and their <br /> decision. Also the staff reports,minutes and exhibits for each of <br /> the public hearings held before the Planning Commission. <br /> He said they would proceed in an orderly manner and staff would <br /> begin and wo ld be allowed 30 minutes. Next w uld be the applicants <br /> presentation <br /> not representatives <br /> exceed minutes. <br /> lsThe neighborhood <br /> would speak <br /> extincludingep sttivesfrom CAREand attorney to <br /> exceed S minutes and following that other citizens would speak <br /> with 1I <br /> a maximum of three minutes each. Applicant will then be provided an <br /> opportunity for rebuttal. <br /> The hearing will then be closed and the council will have discussion <br /> and make decisions If a decision has not been made by midnight, <br /> the meeting will have to recess and convene at another time. <br /> The council members are <br /> o <br /> all concerned that this hearing be fair in <br /> form and substance and fair inappearance as well. He then asked if jl <br /> any council member knows of shy real or potential conflict which <br /> should cause that member to avoid participation in the hearing. <br /> Councilman Moser said at the Planning Commission hearing on Merrill <br /> Creek he fled expressed his close work association with <br /> c <br /> enbergen and he w challenged by the proponent of the project� <br /> v a <br /> Hesaid his position has not changed but he now was representing all <br /> the citizens of Everett by election. He had reviewed the tapes of <br /> the Planning Commission and had read all the material supplied him <br /> and felt he could render a fair and impartial decision. <br /> Joel nagger, attorney for the applicant, objected to Councilman <br /> - Noses participating in the M1earing. <br /> Frank Anderson said he lived a mile from the project, had no <br /> information that was t public'information and felt he could make a <br /> fair decision on the project. No one objected to his participating <br /> in tie hearing. <br /> The citf.Olerk then swore in all citizens who wished to speak. <br /> Nary Cunningham of the Planning Department showed elides of the <br /> proposed project to be rezoned. <br /> She said the city had completed an extensive review of the project <br /> and city counciln <br /> has before them a substtial record of the <br /> Planning Commission hearings. Three volumes of the EIS and notebook I� <br /> which includes the exhibits, minutes and Planning Commission II- <br /> recommendation to City Council. All of these documents are part of <br /> therecord for the purposes of the public hearing and City council's <br /> n <br /> decisiomaking process. She Said there were letters presented to <br /> the council and City Clerk from David T. Gardner, Jeffrey Rhodes, <br /> Eugene Rogers,Jerry Bartok, Sheri Knight, Sonja Roe, Dennis Novak, <br /> Robin Arnold,Wendy Bohn,Jerry Nielsen and Steve Clements. (, <br />
